1444 ORDINANCE NO. 1444 (#06 - 12)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF EXTENDING AND
UPGRADING THE WASTEWATER COLLECTION SYSTEM AND PUMP
STATION OF THE JACKSONVILLE WASTEWATER UTILITY FOR THE
VALENTINE-WOOTEN ROAD PROJECT;AND, FOR OTHER PURPOSES.
WHEREAS, the Valentine-Wooten Road Sewer Project will extend sanitary
sewer service from the Jacksonville Wastewater Utility for an area that has been
unable to obtain such service for many years, and doing so will create five new
pump stations, all of which will become a part of the Jacksonville Wastewater
Utility's collection system and require the upgrade to One (1) existing pump station
(the Valentine Pump Station);
WHEREAS, the Jacksonville Wastewater Utility has been involved in efforts for
the extension of sanitary sewer services to the Valentine-Wooten Road area for
approximately Nineteen (19) years and believes extension of the Utility's system is
best for the citizens of the area and for current and future needs of the Utility; and,
WHEREAS, to do so, it is necessary to obtain new equipment and services for
the existing Valentine Pump Station from Instrument&Supply, Inc. of Hot Springs,
Arkansas, Arkansas representative that markets and services the submersible
pumps tat make up the majority of the Utility's submersible pump stations in the
Collection system, and the Hydromatic equipment to be obtained from ISI is
compatible with the existing equipment used in the majority of the Utility's
Collection system's submersible pump stations.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE, ARKANSAS;
SECTION ONE: Competitive bidding for the purpose of extending sewer
services and upgrading the existing Valentine Pump Station for the Valentine-
Wooten Road Sewer Project and the necessary accompanying equipment for the
Jacksonville Wastewater Utility would be costly, non-productive, and time
consuming, making said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA § 14-58-383, competitive bidding is
hereby waived for the purpose of purchasing Two (2) Hydromatic Model H4Q
sewage pumps and accompanying and appropriate equipment necessary for the
extension of and upgrade of the existing Valentine Pump Station for the Valentine-
Wooten Road Sewer Project, installation, and initial implementation of said
improvements to the Collection System for the Jacksonville Wastewater Utility.
Authorization is hereby given to the Mayor and/or his designated representative to
execute necessary documents with Instrument & Supply, Inc., of Hot Springs,
Arkansas, the only Arkansas supplier of said equipment and services, for said
purchase. It is anticipated that the equipment and services, as specified on the
attached, will be provided for a total cost to the Jacksonville Wastewater Utility not
to exceed Thirty-four Thousand Five Hundred Seventy-nine Dollars ($34,579.00),
together with all applicable taxes and other associated costs due.

SECTION THREE: All Ordinances, parts of Ordinances,or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
