A RESOLUTION CONFIRMING IMPLEMENTATION OF A PASS THROUGH
CHARGE UNDER JMC § 13.16.016 RESULTING FROM ACT 788 TO ALL
JACKSONVILLE WATERWORKS RATEPAYERS AS OF JULY 1, 2019; AND, FOR
OTHER PURPOSES.
WHEREAS, during the 92nd General Assembly of the Arkansas Legislature, House Bill 1737 was
introduced to raise Public Water System Service Fees from $0.30 per meter per month to $0.40 per
meter per month. This bill was the result of the Arkansas Department of Health seeking support for
the safe drinking water program in order to cope with upcoming challenges and increasing costs to
the program. House Bill 1737 became ACT 788 on April 8, 2019.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT. -
SECTION ONE. Pursuant to authority granted under JMC § 13.16.016 and per.
Act 788, ratepayers of the Jacksonville Water Works (JWW) will pay additional amounts for water
service as follows: The new fee rate of $0.40 per meter per month will become effective for JWW
ratepayers the month of July 2019 and thereafter. Per JMC §13.16.016, regardless of the above
calculations, only that exact charge assessed by Act 788 will be assessed against and passed
through to JWW ratepayers, as approved by the Jacksonville Water Commission and this City
Council in compliance with JMC § 13.16.016.
SECTION TWO. Any and all other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict.
SECTION THREE; This Resolution shall be in force and effect from and after
its date of passage.
