1440 ORDINANCE NO. 1440 ( #02 - 2012)
AN ORDINANCE AMENDING JMC §5.32.110 (NONCONSENSUAL TOWING
REGULATIONS); AND, FOR OTHER PURPOSES.
WHEREAS, after study and review, City officials and business members have
determined that an additional new provision is needed for towing and wrecker
service regulations applicable in the City in compliance with ACA § 27 -50 -1101 to
prevent towing of vehicles from private and /or public properties to locations outside
City limits and the assessment of unreasonable and inappropriate towing and
service charges.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE: Jacksonville Municipal Code § 5.32.110 is hereby
created and shall include the following:
JMC § 5.32.110 - Nonconsensual Towing Requirements.
(1) Any towing or wrecker service(s) receiving request(s) for towing services
from public or private property(ies) through an owner /authorized
representative must hold all appropriate licensure(s) and insurance coverage
required by the City and the State of Arkansas for operation of such a
service /business.
(2) As well, said towing or wrecker service(s) must comply with all provisions of
this Chapter, specifically but not limited to, § 5.32.020, § 5.32.030, §
5.32.080, and § 5.32.090 so as to insure applicable service facilities within
the corporate city limits, appropriate times of operation, and appropriate and
reasonable storage and towing service fees and charges.
(3) Failure to conform to all applicable requirements and regulations will result in
the removal of said business /person /entity from authority to conduct
business within the City limits of the City of Jacksonville.
SECTION TWO: All Ordinances and parts thereof in conflict
herewith are hereby repealed to the extent of said conflict.
SECTION THREE: This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
