1439 ORDINANCE 1439 ( #O1 - 12)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF PURCHASING A NEW
MANUAL DEFIBRILLATOR /MONITOR SYSTEM FOR THE JACKSONVILLE
FIRE DEPARTMENT'S FIRE AND RESCUE SERVICES; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, one of the Jacksonville Fire Department's Fire and Rescue
Services' ambulances' is in need of a manual defibrillator to be equally equipped as
the other units;
WHEREAS, the Jacksonville Fire Department has field tested and used Zoll E-
Series Defibrillator Systems for many years and believes this system is best suited
for current and future needs of the Department; and,
WHEREAS, Zoll Medical Corporation of Chelmsord, Massachusetts is the only
company that manufactures and markets the Zoll E- Series Manual
Defibrillator /Monitor System, and their equipment is identical and compatible with
the Fire Department's other such life- saving equipment.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of purchasing a
new Zoll E Series Manual Defibrillator /Monitor System and accompanying Battery
packs for the Jacksonville Fire Department would be costly, non - productive, and
time consuming, making said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA §14 -58 -383 competitive bidding is
hereby waived for the purpose of purchasing One (1) Zoll � Series Manual Monitor
Defibrillator System, including an integral ECG printer patient cables, power cables,
and sensors, together with Three (3) Surepower Lithium Ion Battery packs for the
Jacksonville Fire Department's Fire and Rescue Services. Authorization is hereby
given to the Mayor and /or his designated representative to execute necessary
documents with Zoll Medical Corporation of Chelmsford, Massachusetts, for the
purchase of said equipment. It is anticipated that the equipment, as specified on
the attached invoices, will be provided for a total cost not to exceed Twenty-seven
Thousand One Hundred Nine and 56/100 Dollars ($27,109.56), including all
applicable taxes and other associated costs due.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: To provide more effectively for the health, safety, and
comfort of our citizens and in the operation of our Fire Department's Fire and
Rescue Services, an emergency is hereby declared to exist. This Ordinance shall
take effect immediately upon passage and publication, as provided by and subject to
the requirements of applicable law.
