1596ORDINANCE NO. 1596 (#03- 2019)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARRANSAS, FOR THE PURCHASE OF PLANTERS AND
SELF WA TERING RESERVOIR SYSTEMS; DECLARING AN EMERGENCY;
AND, FOR OTHER PURPOSES.
WHEREAS, the Downtown Development Committee is in need of self -
watering planters for improvements and beautification of downtown Jacksonville;
and,
WHEREAS, the Downtown Development Fund received an anonymous
donation to purchase planters and watering systems for the City ,s use. As a result,
this is an opportunity for the City to acquire said equipment and to allow for
continued enhancement of the downtown area for our citizens,
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Due to the generous donation, competitive
bidding for the purpose of obtainingplanters with self -watering systems for the
Jacksonville Downtown DevelopmenCommittee is unnecessary.
SECTION TWO: Pursuant to ACA § 14-58-303, competitive
bidding is hereby waived for the purpose of purchasing from the Downtown
Development Fund, sixty (60) New Age Modern Planters along with sixty (60) Self -
Watering Reservoir Systems, for use of the Downtown Development Committee.
Authorization is hereby given to the Mayor and/or his designated representative
to execute necessary documents with Flower Window Boxes of Cumming, Georgia,
a supplier of above referenced planters and self -watering systems that has agreed
to accept a purchase price, including shipping and taxes, for the total sum of
Twenty -Nine Thousand Eight Hundred Fifty -Four Dollars and Twenty -Seven Cents
($29,854.27. Anticipated delivery of the planters and self -watering reservoirs is
to be within Thirty (30) days.
SECTION THREE: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.

SECTION FOUR: Because passage of this Ordinance is necessary
for public peace and safety of the citizens of Jacksonville, an emergency is hereby
declared. Thus, this Ordinance shall be in full force and effect immediately upon
and after passage.
