0778RESOLUTION NO. 778 (#1 — 2019) A RESOLUTION AUTHORIZING AND APPROVING AN OPTION AGREEMENT BETWEEN THE CITY OF JACKSONVILLE, ARKANSAS, AND JACKSONVILLE HOUSING SOLUTIONS, INC.; AND, FOR OTHER PURPOSES. WHEREAS, the City of Jacksonville, Arkansas is participating with Jacksonville Housing Solutions, Inc. ("Solutions', a 501(c)(3) organization affiliated with the Jacksonville Housing Authority, to bring the development of quality housing for persons of low to moderate income in the City of Jacksonville, Arkansas; and, WHEREAS, it is in the interest of the City of Jacksonville to enter into the attached Option Agreement (the "Agreement's with Solutions, whereby the City will sublease a tract of land in the City of Jacksonville, Arkansas, located at 108 South Oak Street, the legal description for which is as set forth on the Lease, a copy of which is attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THA T: SECTION ONE; The Agreement, in substantially the form presented at the Council Meeting at which this Resolution is addressed, is hereby approved, and the Mayor and City Clerk of the City are hereby authorized to execute the Agreement on behalf of the City, with such changes as may be approved by the Mayor consistent with the Agreement presented and the terms of this Resolution. SECTION TWO. The Mayor and City Clerk of the City of Jacksonville, Arkansas, are hereby authorized to execute such writings and take such actions as may be appropriate to carry out the terms of this Resolution consistent with the purposes of this Resolution, including execution of the Agreement. Such action is hereby ratified. SECTION THREE. It has been found that the Agreement is plainly in the interest of the City and that its execution is essential to the development of future quality housing for persons of low to moderate income to be made available pursuant to the Agreement. Therefore, this Resolution, being necessary for the preservation of the public health and safety, shall be effective upon and after its date of adoption.
