RESOLUTION NO. 775 (#12- 2018)
A RESOLUTION EXPRESSING WILLINGNESS OF THE CITY OF
JACKSONVILLE, ARKANSAS, TO UTILIZE FEDERAL AID SURFACE
TRANSPORTATION PROGRAM FUNDS FOR THE THE ONEIDA
STREET BRIDGE REPLACEMENT PROJECT; PROVIDING FOR
PA YMENT OF THE DESIGN PHASE OF THE PROJECT AND WAIVING
COMPETITIVE BIDDING; DECLARING AN EMERGENCY; AND, FOR
OTHER PURPOSES.
WHEREAS, despite passage of Resolution No. 771 (#08-2018) and
the expressions and authorizations contained therein, the City of
Jacksonville, Arkansas, in application of the design phase for the Oneida
Street Bridge Replacement Project, have learned that shared costs between
the City of Sherwood, Pulaski County, and the City of Jacksonville will require
funds for the design phase of the Project exceeding One Hundred Thousand
Dollars ($100,000.00) and require additional approval;
WHEREAS, Mayor Fletcher and City Clerk Davitt will need to be
authorized to execute the appropriate Agreements and other relevant
documents to allow the City of Jacksonville to participate in said Project;
WHEREAS, the City of Jacksonville understands that monies through
the Federal -Aid Surface Transportation Program Funds and State Aid Funds
are potentially available on a reimbursable basis, but initially our One-third
(1/3) share of the Design Phase will be approximately Thirty-nine Thousand
Six Hundred Twenty-seven and 33/100 Dollars ($39,627.33), requiring
design work to be accomplished and proof of payment prior to the possibility
of actual monetary reimbursement is granted; and,
WHEREAS, the Oneida Street Bridge Replacement Project, hopefully
using a combination of Local, State, and Federal funding, will be open and
available for use by the general public and maintained by the participating
entities for the life of the Bridge.
NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL
OF THE CITY OFJACKSONVILLE, ARKANSAS, THA T.-
SECTION ONE; The City of Jacksonville, Arkansas, as
previously authorized in Resolution No. 771 (#09-2018), again expresses its
willingness to participate in the Oneida Street Bridge Replacement Project in
accordance with its designated proportional responsibilities and share,
including development, construction, and maintenance of the Oneida Street
Bridge Replacement Project.

SECTION TWO: The Mayor and City Clerk are hereby
authorized and directed to execute all appropriate agreements and contracts
necessary, after approval of such by the City Attorney, to expedite the
Design Phase of the Project as outlined above and as required by any
specific terms required for completion of that phase of the Project.
SECTION THREE; Competitive bidding for the design phase
of the Oneida Street Bridge Replacement Project as outlined herein would be
costly and non-productive, making said competitive bidding unfeasible and
impractical. Competitive bidding is hereby waived, pursuant to ACA §14-58-
383, to authorize contracting with Halff Association, Inc., for the design
services needed for the Oneida Street Bridge Replacement Project.
Authorization is hereby given to the Mayor and/or his authorized
representative(s) to enter into contract with the City of Sherwood, Pulaski
County, and Halff Association, Inc. for said Design Services, all for a total
proportional costs to the City of Jacksonville not to exceed Thirty-nine
Thousand Six Hundred Twenty-seven and 33/100 Dollars ($39,627.33).
SECTION FOUR: The City Council of the City of Jacksonville,
Arkansas, pledges its full support and hereby authorizes such approval and
willingness of the City to untilize Federal Aid Surface Transportation Program
Funds, together with any other such local, state, and federal funds available
for initiation and implementation of the Oneida Street Bridge Replacement
Project.
SECTION FIVE; Any other Resolutions in conflict herewith
are hereby repealed to the extent of said conflict. This Resolution shall be in
effect from and after its date of passage.
SECTION SIX: This Resolution, because of the immediate
need to obtain the Design Services needed as addressed herein for the
replacement of the Oneida Street Bridge, requires that an emergency is
hereby declared. As a result, this Resolution shall take effect immediately
upon passage and publication, as provided by and subject to the
requirements of applicable law.
