A RESOLUTION ;SUPPORTING APPROPRIATE LEGISLATION TO
ENCOURAGE PROPER ASSESSMENT AND COLLECT['ON OF SALES
TAX FROM ALL .INTERNET%ONLINE SALES TO CREA TE A FAIR AND
FREE MARKET FOR AL L BUSINESSES AIVD CONSUMERS IN LIGHT OF
THE U.S. .SUPREME COURT DECISION IN SOUTH DAKOTA V
WA YFAIR INC ET.AL. AND, FOR OTHER PURPOSES.
WHEREAS, the City recognizes that legislation: frequently referred to
as the Marketplace Fairness and Remote Transactions Parity Act ("this
Legislation") is under consideration by Congress;.
WHEREAS such Legislation, previously considered by the 2017
Arkansas General Assembly, would provide States the authority to impose
Local. and. State taxes already in place. on out—of-state online retailers. This
Legislation would require retailers, regardless of their physical location, to
collect and remit sales tax to States and local governments sales taxes;
WHEREAS, since the U.S. Supreme Court's recent decision in South
Dakota v. NIa fair Inc. et aL provides legal precedent for State legislation
mandating collection and payment of sales tax by out-of-state internet.
retailers, Arkansas should not delay in the adoption and passage of such
legislation to put:ALL.retailers on equal footing; and.,
!WHEREAS, this Legislation is not a new tax./increase, but rather
enables States and local governments to .collect sales taxes already due but:
currently being uncollected or paid by out -of -State internet retailers. This
legislation. will likely generate more. sales, sales tax revenues, and. encourage
local retailers to create additional jobs for local citizens and infuse more
funds into local economies throughout the State of Arkansas.
NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THA T•
SECTION ONE: We hereby encourage and urge all members
of Congress, particularly the Arkansas Congressional delegation, AND the:
Arkansas General Assembly to support passage and vote in favor of
Legislation requiring collection and remittance of State an.d .local safes taxes
by ALL retailers regardless of sales locations.. We encourage the. Arkansas
General Assembly to be pro -active in the creation of a fair and competitive
free market in Arkansas, giving ALL businesses an equal opportunity to.
compete, improve sales, and create new jobs.

SEMON rWO: We hereby urge Governor Asa Hutchinson
to call. a Special Session of the Arkansas General Assembly as quickly as
possible and urge all Legislators to seek adoption and passage of sales tax
legislation for .ALL retailers; regardless of location, for the benefit of all of
Arkansas' local retailers and businesses.as well as its citizens..
SECTION THREE: This Resolution, being necessary for the
betterment of the public utility and in the continuing purpose of protecting
the public's health and safety, shall be in effect from and after its date of
adoption.
SECTION FOUR.' Any other Resolutions in conflict herewith
are hereby repealed to the extent of said conflict.. This. Resolution .shall be in
effect from and after its date of passage.
