AN ORDINANCE VACATING AND CLOSING A PORTION OF AN ALLEY ALONG LOTS 1,
2, & 3, BLOCK 4, OF THE HARPOLE ADDITION, JACKSONVILLE, ARKANSAS
(GENERAL LOCATION: PORTION OF AN ALLEY OFF OF VINE STREET IN THE
HARPOLE ADDITION, JACKSONVILLE); AND, FOR OTHER PURPOSES.
WHEREAS, the Jacksonville City Council hosted a Public Hearing regarding the closure
and abandonment of a portion of an alleyway located off of Vine Street in the Harpole
Addition, City of Jacksonville, on April 16, 2009, with notice duly published as required by law.
At said Public Hearing, the written approval of all adjacent property owners was presented
and utility companies expressed consent to the closing of said street, subject to reservation of
easement rights for said utilities.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Public Right -of -Way Easement being abandoned is more
particularly described as follows:
Legal description: An alley located between Lots 1, 2 and 3 in Block 3,
Harpole Addition to the City of Jacksonville, Pulaski County, Arkansas.
A 20 -foot alley located in Block 4, Harpole Addition to the City of Jacksonville,
Pulaski County, Arkansas, more particularly described as follows: Begin at the
Southwest corner of Lot 1, Block 4, Harpole Addition, thence West a distance
of 20 feet along the North right -of -way line of Vine Street to the Southeast
corner of Lot 3, Block 4, Harpole Addition; thence North along said Lot 3 lot
line to the South lot line of Lot 1, Block N.E. and Harry Harpole Addition;
thence South 88° 38' 31" East a distance of 20 feet to the Northwest corner of
Lot 2, Block 4, Harpole Addition; thence South 01° 45' 45" West a distance 140
feet to the point of beginning, containing .06 acres, more or less.
(GENERAL LOCATION: A portion of the alley located off Vine Street in the
Harpole Addition, City of Jacksonville, Arkansas)
Said Right -of -Way Easement is hereby abandoned under the powers granted to cities of the
First Class in the State of Arkansas, subject only to reservation of easement rights and
privileges for private and municipal utility companies. The Mayor and City Clerk are hereby
duly authorized and directed to approve the appropriate documents designating the Easement
as described above closed and abandoned. The real property rights described herein shall
revert to the current adjoining property owners, identified as The Rice Family Living Trust, of
the real property affected in accordance with State law.
SECTION TWO: A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Office of the Recorder of the County and recorded in the Deed Records of the
County, hereby amending the plat in the Pulaski County Circuit Clerk Records.
SECTION THREE: All Ordinances or parts thereof in conflict herewith are hereby
repealed to the extent of said conflict.
SECTION FOUR: This Ordinance shall take effect immediately upon passage and
publication, as provided by and subject to the requirements of applicable law.
