ORDINANCE NO. 1366 ( #09 - 09)
AN ORDINANCE ACCEPTING AND CONFIRMING ANNEXATION OF
CERTAIN LANDS TO THE CITY OF JACKSONVILLE, ARKANSAS (COMMONLY
REFERRED TO AS THE EMMANUEL BIBLE FELLOWSHIP CHURCH
PROPERTY); AND, FOR OTHER PURPOSES.
WHEREAS, through Resolution No. 620 ( #13 -08), the Jacksonville City
Council urged the submission and approval of a Petition for Annexation of certain
lands to the City of Jacksonville, Arkansas, a part of Pulaski County;
WHEREAS, said Petition for Annexation was filed, Public Notice was duly
published, and a Public Hearing was held on March 3, 2009. Subsequently, County
Judge Floyd G. Villines III entered an Order of Annexation for the following
described property into the City of Jacksonville. Under statute, the City Council
must now confirm and accept said Annexation action by Judge Villines.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE: The following described property is hereby annexed and
accepted into the City of Jacksonville, Arkansas:
Part of the Northwest Quarter of the Northwest Quarter of Section 22,
Township 3 North, Range 11 West, Pulaski County, Arkansas, being
more particularly described as follows: Commencing at the Northeast
corner of said NW 1 /4 NW 1/4; thence N 89° 50' 00" W, 417.40 feet;
thence S 00° 12' 00" W, 208.7 feet to the point of beginning; thence
continue S 00° 12' 00" W, 378.3 feet; thence S 51° 12' E, 277.59
feet; thence N 0° 26' W, 551.7 feet; thence N 89° 50' W 210.76 feet
to the POINT OF BEGINNING; said described tract containing 2.23
acres, more or less.

Part of the Northwest Quarter of the Northwest Quarter of Section 22,
Township 3 North, Range 11 West, Pulaski County, Arkansas, being
more particularly described as follows: Commencing at the Northeast
comer of said NW 1 /4 NW 1 /4; thence N 89° 50' 00" W, 417.40 feet;
thence S 00° 12' 00" W, 208.7 feet to the point of beginning; thence
S 0° 31' 06" E, 241.47 feet; thence S 1° 28' 06" W, 136.75 feet;
thence N 0° 12' 00" E, 378.17 feet to the POINT OF BEGINNING; said
described tract containing 0.013 acre, more or less.

thence N 0° 21' 56" W, 208.71 feet (deed North 208.7); thence S 89°
50' 00" E, (deed East) 208.70 feet to the POINT OF BEGINNING; said
described tract containing 1.00 acre, more or less.

said Annexation are attached hereto and made a part hereof.]
SECTION TWO: The City hereby declares its intention to extend City
utility services to said areas within a reasonable time frame. Portions of the area
involved are currently having water and sewer main lines constructed through the
area, and the area will now be served by the Police, Fire, and Emergency Services
Departments. Sanitation services and other City services are to be extended within
a reasonable time frame as service expansion allows.
SECTION THREE: All Ordinances or parts of Ordinances and Resolutions in
conflict herewith are hereby repealed to the extent of said conflict.
SECTION FOUR: It is hereby ascertained and declared that this Ordinance
is necessary for immediate implementation of greater efficiency in governmental
and emergency services operations. Therefore, an emergency is hereby declared,
and this Ordinance shall take effect immediately upon passage and publication, as
provided by and subject to applicable law. -- II
