0674 RESOLUTION NO. 674 ( #20- 2011)
A RESOLUTION AUTHORIZING AND APPROVING AN ADDENDUM TO THE
WATER PURCHASE AGREEMENT BETWEEN THE CITY OF JACKSONVILLE,
ARKANSAS, BY AND THROUGH THE JACKSONVILLE WATER WORKS, AND
LONOKE WHITE PUBLIC WATER AUTHORITY; PROVIDING FOR CERTAIN
OTHER MATTERS RELATING THERETO; DECLARING AN EMERGENCY, AND,
FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, by and through the Jacksonville
Water Works, is a participating utility in the Lonoke White Public Water Authority of the
State of Arkansas C'LWPWA') project, which will bring surface water from Greers' Ferry
Lake to the North Central Arkansas area;
WHEREAS, the City of Jacksonville, Arkansas, and LWPWA previously entered
into a Water Purchase Contract with an effective date of November 9, 2010;
WHEREAS, USDA and ANRC are providing funding for the LWPWA project and
have placed certain conditions and requirements for that funding that require and
Addendum to the original Water Purchase Contract; and,
WHEREAS, it has been found that it is in the interest of the City of Jacksonville,
Arkansas, by and through the Jacksonville Water Works, to execute the attached
Addendum to the Water Purchase Contract ("Agreement ") with LWPWA.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OFJACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Agreement, in substantially the form presented
at the meeting at which this Resolution is addressed, is hereby approved, and the Mayor
is authorized to execute the Agreement on behalf of the City, with such changes as may
be approved by the Mayor consistent with the Agreement presented and the terms of
this Resolution.
SECTION TWO; The Mayor of the City of Jacksonville, Arkansas, is
authorized to execute such writings and take such actions as may be appropriate to
carry out the terms of this Resolution. Action heretofore taken by the Mayor and
consistent with the purposes of this Resolution, including execution of the Agreement, is
hereby ratified and approved.
SECTION THREE: It has been found that the Agreement is plainly in
the interest of the City and that its execution is essential to the development of an
alternative future supply of water to be made available pursuant to the Agreement.
Therefore, it is hereby declared that an emergency exists and this Resolution, being
necessary for the immediate preservation of the public health and safety, shall take
• effect and be enforced from and after its adoption.

SECTION FOUR: Any and all other Resolutions in conflict herewith
are hereby repealed to the extent of said conflict. This Resolution shall be in effect from
