ORDINANCE NO. 1345 ( #12 — 08)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF AN UPPER BEARINGASSEMBL YFOR USE ON THE INTERNALIFT PUMP
FOR THE JACKSONVILLE WASTEWATER UTILITY; AND, FOR OTHER
PURPOSES.
WHEREAS, the Jacksonville Wastewater Utility is in need of a Bearing
Assembly to be used on their Internalift Pump; and,
WHEREAS, said Bearing Assembly is not commercially available, is a
proprietary item, and Siemens Water Technologies Corp. is the sole and exclusive
source for such. Siemens Water Technologies agrees to furnish said Bearing
Assembly at a competitive cost and in a timely manner. As such, the Departmen
recommends waiver of competitive bidding and request that they be allowed to
contract with Siemens to purchase the needed Bearing Assembly.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6F THE CITY OF ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purchase of a Bearing
Assembly for the Jacksonville Wastewater Utility would be costly and non-
productive, making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
l §14-58-383, to authorize the purchase of a Bearing Assembly to be used on the
nternalift Pump for the Jacksonville Wastewater Utility. Authorization is hereby
given to the Mayor and City Clerk to enter into a contract with Siemens Water
Technologies Corp., of Thomasville, Georgia, for the purchase of said Bearing
Assembly at a cost not to exceed Twenty-six Thousand, Seven Hundred Twenty-five
Dollars and forty-eight cents ($26,725.48), together with any applicable tax and
shipping charges.
SECTION THREE: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applicable law.
