AN ORDINANCE ABANDONING A PUBLIC RIGHT OF WAY LOCATED IN THE
WEST JACKSONVILLE SUBDIVISION, NO. 1, JACKSONVILLE, ARKANSAS
MAIN AND WAR WARREN TO
REN STREETSJ• AND, FOR OTHER PURPOSES.
WHEREAS, a public right of way easement designated for an alleyway running between
platted lots across real property in the West Jacksonville Subdivision, No. 1, is no longer needed.
Under plans submitted by the City of Jacksonville, the existing public easement will no longer be
needed, and other access is proposed in new development plans submitted for said property;
WHEREAS, the Jacksonville City Council hosted a public hearing regarding said
abandonment of public right of way on March 1, 2007, with notice of said meeting duly published
as required by law. Because the City owns all surrounding property and no utilities are placed in
said right of way, no consent is necessary from other parties; and,
WHEREAS, proposed plans allow placement of the new library facility across said easement
area and public access around the outer edges of said property. Said plan has been preliminarily
reviewed and approved by the Planning Commission.
NOW THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL 6 F THE CITY OF JACKSONVILLE, ARKANSAS, THAT ;;
SECTION ONE: The Public Right -of -Way Easement in question is described as part
of the West Jacksonville Subdivision No. 1, Jacksonville, Pulaski County, Arkansas; being more
particularly described as follows:
Beginning at the northeast corner of Tract A of said Subdivision and the point of beginning; thence
south along the east line of Tract A, 290 feet; thence east 20 feet; thence north along the west
lot lines of lots 32, 33, & 34, of the West Jacksonville Sub division 1, 150 feet; thence N 2 15 ,

00" W, 140 feet to the south line of West Main Street; thence west along the south line of West
Main Street 20 feet to the point of beginning, containing 0.13 acres more or less.
Said Right -of -Way Easement is and shall be hereby abandoned under the powers granted to Cities
of the First Class in the State of Arkansas. The Mayor and City Clerk are hereby duly authorized
and directed to approve the appropriate documents designating the easement described above

SECTION TWO: A copy of this Ordinance, duly certified by the City Clerk, shall be
filed in the Pulaski County Circuit Clerk's Office, Real Estate Division, and recorded in the Deed
Records of the County, hereby amending the plat recorded on November 1, 1920, in said records.

repealed to the extent of said conflict.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval, and date of publication, as outlined under state law.
