1302 ORDINANCE NO. 1302 ( #1 - 07)
AN ORDINANCE TO ESTABLISH AND LAY OFF THE CITY OF
JACKSONVILLE MUNICIPAL MULTIPURPOSE PROPERTY
OWNERS' IMPROVEMENT DISTRICT, NO. FOUR (THE MEADOWS
MUNICIPAL PROPERTY OWNERS' IMPROVEMENT DISTRICT); AND,
FOR OTHER PURPOSES.
WHEREAS, a Petition and Revised Petition for the City of Jacksonville
Municipal Property Owners Multipurpose Improvement District, No. Four (The
Meadows Municipal Property Owners' Improvement District) has been filed with the
Jacksonville City Clerk;
WHEREAS, this day, having been set as the date and time for the matter to
come before the Jacksonville City Council for consideration of said Petitions, the
City Council has been presented a Certificate of Abstract, Property Ownership
Verification, and other pertinent documents declaring that those executing the
Petitions as attached include all of the owners and interested parties of the real
property to be located within said District; and,
-- - WHEREAS, Arkansas laws regarding Property Owners' Multipurpose
Improvement Districts provides that, if the governing body determines that all
owners of the rear property to be located within the District have petitioned for said
improvements, it shall then establish by Ordinance such a District as defined in the
attached Petition and shall appoint commissioners as requested.
NOW, THEREFORE, BE ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: The real property described in Exhibit "A attached hereto
and made a part hereof is hereby established and designated as the City of
Jacksonville Property Owners' Multipurpose Improvement District, No. Four (The
Meadows Municipal Property Owners' Improvement District) for the purpose of
constructing, either within or outside of the boundaries of said District if the property
within said District will be benefited thereby, a sewage collection system, a water
distribution system, a storm drain collection and distribution system, a telephone
service system, a cable television service system, an electrical distribution system,
a natural gas distribution system, adequate roads, streets, street lighting, and other
such transportation improvements, including sidewalks, curbs, and gutters, a system
of retention basins and /or walls, landscaping and adequate trenching, excavation,
grading, and erosion control, sufficient engineering and preliminary planning,
studies, and surveys relative thereto, all construction associated with the installation
of the above systems, and for all purposes and funded as authorized under
Arkansas law, as amended, as necessary in order to purchase, construct, operate,
receive, and maintain any and all improvements authorized herein or within the
scope of power and authority granted through ACA §14 -94 -101 et. seq.
SECTION TWO: The following three (3) individuals are hereby appointed
as the initial commissioners of said Improvement District: B.J. Boroughs; Brian
Boroughs; and, Tammy Tompkins. These individuals are empowered to adopt the
necessary provisions, in accordance with ACA §14 -94 -101 et. seq., for the creation,
operation, and imposition of financial obligations to operate said Improvement
District.

SECTION THREE: The name of the Improvement District shall be the City
of Jacksonville Municipal Property Owners' Multipurpose Improvement District, No.
Four (The Meadows Municipal Property Owners' Improvement District).
SECTION FOUR: All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION FIVE: This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
