0458 • • O RDINANCE NO. 4 5 8 AN ORDINANCE AMENDING SECTIONS 2.141; 2.211; 2.212; 2.213 OF ORDINANCE NO. 154 AND SECTIONS 17.12.110, 17.12.160, 17.12.170 AND 17.12.180 OF THE JACKSONVILLE MUNICIPAL CODE. (REGARDING REQUIREMENTS ON FINAL PLATS; LOT -SPLIT PLATS OR REPLATS) WHEREAS, the Jacksonville Planning Commission has recommended to the Jacksonville City Council that it would be beneficial to the City that the Jacksonville Municipal Code be amended. NOW, THEREFORE, BE IT ORDAINED SY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, that: jAHNEONVTLLETAAKANSAftmthatt- Section 1. Sections 2.141, 2.211, 2.212 and 2.213 of Ordinance No. 154 and Sections 17.12.110, 17.12.160, 17.12.170 and 17.12.180 of the Jacksonville Municipal Code are hereby amended in their entirety to read as follows: Section 17.12.110 Final Plat - Materials to be submitted. A. The subdivider shall present the following materials to the city engineer at least seven days prior to the meeting at which consideration is requested: 1. The original tracing of the final plat for signature. 2. Plans for all improvements required under these regulations, such plans to bear the approval of the city engineer. 3. The proposed protective covenants, if any. B. The "as built" specifications and "as built" prints in sufficient quantity of the paving, water, sanitary sewer and drainage plans shall be presented to the city engineer as soon as the improvements are completed. The city eng- ineer shall enter the date of receipt on these materials. The city engineer shall advise the Planning Commission of acceptable performance by the subdivider. Section 17.12.160 Lot -split plat or Replat - Approval by Planning Commission agent. The planning commission may empower the city engineer or other city administrative officer to approve by endorse- ment on behalf of the planning Commission, lot -split plats that meet all of the requirements for lot -split plats as set forth in these regulations. Replats shall be handled in the same manner as an original plat with particular attention to utility location requirements and drainage to serve new lots. Section 17.12.170 Lot -split plat or Replat - Referral to Planning Commission. Whenever a subdivider desires to create a lot -split or re- plat, he shall present the lot -split plat or replat to the designated agent of the Planning Commission. If said agent disapproves the lot -split or replat because said plat does not meet all the requirements set forth in these regulations for lot -split plat or replat, or if an adjoining property owner protests the lot -split plat or replat within five days after said plat has been presented, then said agent shall refer the lot -split plat or replat to the Planning Commission for consideration. J 458 PAGE TWO ORD. # Section 17.12.180 Lot -split plat or Replat - Report to Planning Commission. All lot -split plats or replats approved by the Planning Commission agent shall be reported to the Planning Commission at its next regular scheduled meeting. Section 2. This ordinance being necessary for the immediate preservation of the health, safety and morale of the citizens of the City of Jacksonville, Arkansas an emergency is hereby declared to exist and this ordinance shall take effect immediately upon its passage and approval.
