0757RESOLUTION NO. 757 (#10 -- 2417) A RESOLUTION APPROVING AND GRANTING AUTHORIZATION TD MA YOR FLETCHER AND OTHER OFFICIALS FOR THE SALE OF CERTAIN REAL PROPERTY DESCRIBED HEREIN (GENERAL LOCATION; 21739 WEST MAIN (PARCEL Q, CABOT, ARKANSAS); AND, FOR OTHER PURPOSES. WHEREAS, the real property described below is owned and maintained by the City through the Jacksonville Medical Center, Inc.; and, WHEREAS, after consideration and negotiation, it is hereby found that it is in the best interests that the City/Center for entry and approval of an Agreement to sell the remaining outlying parcel of said property for construction conducive to the Center's current use of the adjoining property as the Cabot Medical Clinic. NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY OFJACKSONVILLE, ARKANSAS, THA T.- SECTION ONE. The Mayor, City Clerk, and other designated officials of the City of Jacksonville, Arkansas, are hereby authorized to execute any and all sales documents for the real property described herein. The City Council recognizes and agrees that doing so will, hopefully, benefit both the Medical Center and the area's citizens utilizing the businesses to be developed and located thereon. The Council hereby authorizes Mayor Fletcher, City Clerk Davitt, City Attorney Robert Bamburg, and other designated officials to draft, execute, and complete the appropriate documents required to approve the sale of the property described below; Part of the NE 1/4 of Section 14, T -4-N, R -10 -VII, Cabot, Lonoke County, Arkansas, being more particularly described as follows; Commencing at the NW Corner, NE 1/4, Section 14, T -4-N, R -10-W; thence S00007'02"W, 2031.54 feet; thence S7498'36"E, 1385.74 feet; thence N001110'41"W, 1113.68 feet to the Point of Beginning; thence N001114'41"W, 549.96 feet; thence S71055'57"E, 165.05 feet; thence S67011'51"E, 94.41 feet; thence S16159'48"W, 140.91 feet; thence N72118'13"W, 29.75 feet; thence S17000'46"W, 104.72 feet; thence S72159'14"E, 45.37 feet; thence S16057'58"W, 139.45 feet; thence S731102'02"E, 144.90 feet; thence S05032'44"W, 50.58 feet; thence S89049'19"W, 279.64 feet to the Point of Beginning, containing 2.361 acres, more or less. *Property also part of 2039 W. Main, Cabot, Arkansas 72023* Part of l_onoke County Parcel No. 723-70571-201 Resolution No. 757 (#10— 2017) Page Two SECTION TWO: The Mayor, City Clerk, and designated officials are hereby authorized and directed to execute all appropriate agreements and contracts necessary to expedite the Ingress/Egress Easement on the above stated parcel as required by the parties' agreed terms. SECTION THREE: This Resolution, being necessary for the betterment of the public utility and in the continuing purpose of protecting the public's health and safety, shall be in effect from and after its date of adoption. SECTION FOUR: Any other Resolutions in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of passage.
