• ORDINANCE NO. ./4/4- AN ORDINANCE CLOSING AND ABANDONING IIARVEY STREET FROM THE SOUTH BOUNDARY OF LOT 16, BLOCK 2, TI IOMPSON ADDITION TO THE CITY OF JACKSONVILLE, ARKANSAS TO TI IE NORTH BOUNDARY OF LOT 1, BLOCK 4, BROWN ADDITION TO THE CITY OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY AND FOR AI.i. OTHER PURPOSES. WHEREAS, the City Planning Commission of the City of Jacksonville, Arkansas, has determined that a need exists to close and abandon a part of Harvey Street in the Brown Addition and Thompson Addition to the City of Jacksonville, Arkansas; • WHEREAS, this matter was submitted to the City Council for the City of Jacksonville, Arkansas, and a hearing date set for io,t l7 , 1976, and that public notice thereof was duly published as required by law in the Jacksonville News, a bona fide newspaper having general circulation in the City of Jacksonville, Arkansas; WHEREAS, there was no hearing objection by any resident or citizen of the City of Jacksonville, Arkansas, to the closing and abandoning of said street, which is dedicated but not used as a street: WHEREAS, all adjoining property owners have in fact consented to the closing of Harvey Street in the Brown Addition and Thompson Addition to the City of Jacksonville, Pulaski County, Arkansas, as aforesaid. NOW, THEREFORE, BE IT ORDAINED BY 'HIE CITY COUNCII. OF THE CITY OF JACKSONVILLE, ARKANSAS, that: Section 1. That Harvey Street from the South boundary of Lot 16, Block 2, Thompson Addition to the City of Jacksonville, Arkansas to the North boundary of L.ot 1, Block 4, Brown Addition to the City of Ja cksonville, Arkansas, should be and hereby is closed and alktndoned under the powers granted to cities of the first class in the State of Arkansas. Section 2. That this ordinance being necessary for the immediate preservation of the public health, safety, welfare and morale of the citizens of the City of Jacksonville, Arkansas, an emergency is hereby declared to Page Two • exist and this ordinance shall have full force and effect immediately after its passage. BEFORE THE CITY COUNCIL, CITY OF JACKSONVILLE, PULASKI COUNTY, ARKANSAS IN THE MATTER OF THE ABANDONMENT AND CLOSING OF PART OF HARVEY STREET PETITION Comes James F. Morton and Elizabeth Morton, his wife, the petition- ers herein, and state: 1. That Harvey Street is a dedicated street located in the City of Jacksonville, Pulaski County, Arkansas, more particularly described in the plat of the Brown Addition and Thompson Addition to the City of Jacksonville, Pulaski County, Arkansas, which plats are recorded in the office of the Circuit Clerk and Ex- Officio Recorder in and for Pulaski County, Arkansas, appearing in Plat Books 4 and 5, at Pages 283 and 29, respectively. A copy of said plats are attached hereto and made a part hereof. 2. That the right of way from the South boundary of Lot 16, Block 2, Thompson Addition to the City of Jacksonville, Arkansas to the North boundary of Lot 1, Block 4, Brown addition to the City of Jacksonville, Arkansas has not been paved, graveled or in any other manner made usable as a public street. That said street is not required for public purposes and the Glty .of Jacksonville would be benefited by the abandonment of such street. 3. That the petitioners herein constitute all the persons owning real property abutting any part of Harvey Street sought to be abandoned and they desire that the same be abandoned as a public street and this petition constitutes their written consent to such abandonment. WHEREFORE, petitioners pray that the Jacksonville City Council by resolution set a time and date for a hearing in this matter and direct the City Clerk to publish notice of such hearing in accordance with law; that at such hearing all abutting property owners and other interested persons be given the opportunity to be heard in the matter; that the Jacksonville City Council make a determination that the said portion of Harvey Street from the South boundary of Lot 16, Block 2, Thompson Addition to the City of Jacksonville, Arkansas to the North boundary of Lot 1, Block 4, Brown Addition to the City of Jacksonville, Page Two Arkansas is not required for public purposes and the City of Jacksonville would be benefited by the abandonment of the same; that all abutting property owners have consented to such abandonment; that the Jacksonville City Council adopt an ordinance abandoning said portion of Harvey Street and setting forth such findings and, further, vesting the absolute ownership of such property abandoned in the owners of the fee simple title to such property free from the former easement of the City of Jacksonville therein for public use as a street; and for any and all other proper action to which the petitioners may be entitled.
