0366 ORDINANCE NO. - 4 i
AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN REAL
PROPERTY FOR STREET PURPOSES, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS , there exists a need to improve the flow of traffic at
the intersection of Marshall Road and West Main Street in the City of Jack-
sonville, Arkansas;
WH E REA S , the Arkansas State Highway Department has agreed
to revise and construct a new and improved traffic interchange at said
intersection if the City of Jacksonville will furnish the needed right of way
therefor;
WHEREAS , Frank Carder, Jr. and Mary Jane Carder, his wife,
are the record owners of the hereinafter described real property which
constitutes the needed right of way for said project; and
W H E REA S , said property owners have offered said property to
the City of Jacksonville at a cost of $30,000.00, which is a fair and reason-
able price therefor;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS,
that:
SECTION 1. The Mayor of the City of Jacksonville, Arkansas is here-
by authorized to purchase from Frank Carder, Jr. and Mary Jane Carder,
his wife, at a cost of $30,000.00, the following described real property,
to -wit:
Part of the Southeast Quarter of the Southeast Quarter of Section
24, Township 3 North, Range 11 West, Pulaski County, Arkansas,
more particularly described as follows:
Starting at the Southeast Corner of the Southeast Quarter of the
Southeast Quarter of Section 24; thence North 00 33' West along
the East line thereof a distance of 1043.4 feet to a point on the exist-
ing northwesterly right of way line of U. S. Highway 67; thence
South 44 45' West along said existing right of way line a distance
of 27.9 feet to a point; thence South 46 ° 43' West along said exist-
, ing right of way line a distance of 204.1 feet to a point; thence
South 40 52' West along said existing right of way line a distance
of 159.98 feet to the point of beginning; thence continue South 40
52' West along said existing right of way line a distance of 159.66

feet to a point on the proposed southerly right of way line of John
Harden Drive; thence North 83 25' West along said proposed
right of way line a distance of 190.07 feet to a point; thence South
56 15' West along said proposed right of way line a distance of
69.53 feet to a point on the existing easterly right of way line of
Marshall Road; thence North 06 35' East along said existing right
of way line a distance of 212.0 feet to a point on the proposed
northerly right of way line of John Harden Drive; thence South
43 48' East along said proposed right of way line a distance of
120.74 feet to a point; thence South 83 25' East along said pro-
posed right of way line a distance of 105.83 feet to a point; thence
North 79 14' East along said proposed right of way line a distance
of 140.54 feet to the point of beginning and containing 0.73 acres,
more or less.
SECTION 2. Said purchase of said real property shall be coordinated
with project plans of the Arkansas State Highway Department for the afore-
said road improvement project.
SECTION 3. This ordinance being necessary for the immediate
preservation of the public health, safety, welfare and morale of the citizens
of the City of Jacksonville, Arkansas, an emergency is hereby declared to
exist and this ordinance shall have force and effect immediately after its
passage.
