AN ORDINANCE AMENDING JMC ~ 13.16010;. MODIFYING OUTSIDE THE CITY
BULK RA TE WA TER USAGE RA TES; DECLAtdNG AN EMERGENCY; AND, FOR
OTHER PURPOSES.

WHEREAS, the City of Jacksonville, Arkansas, purchases the majority of its water from the
City of North Little Rock Municipal Water Works, who obtains its water from the City of Little Rock
Municipal Water Works; and,
WHEREAS, recent events had led the Jacksonville Water Commission to believe that a
modification of the Outside the City water usage (bulk rate) rate structure is needed. Because the cost
factor is dependent upon the amount of water purchased and other factors, modification of the rate
structure would allow the Jacksonville Water Commission to better determine the most appropriate
water rates to be paid the Jacksonville Water Department by its bulk rate outside the City customers.
Given the influence on said amounts by projected capital improvement costs, billing fees, special
assessments, and taxes, the Jacksonville Water Commission recommends that the rate structure be
modified for outside the City bulk rate water users.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCil OF THE
CITY OF JACKSONVillE, ARKANSAS, THAT:
SECTION ONE: JMC ~ 13.16.010 is hereby amended, changed, and modified to include the
following:
OUTSIDE CITY - BULK RATE
For all outside the City Bulk Rate customers (those utilizing an average of over 750,000 gallons per
month), the Jacksonville Water Commission shall determine the appropriate rate structure for said
customer(s) and enter into a contract with said customer(s) declaring such rate structure on an annual
basis. Rate structures, formulas, and amounts may be determined for up to a period of twenty (20)
years. Factors to be included in the determination of said rate structures, formulas, and amounts (but
not limited to) shall be: the cost factor and amount of water purchased on an average monthly basis
by the individual customer, billing fees; special assessments; taxes; and, capitol improvement costs
(both those required to provide transmission of the water purchased and overall department
improvements. The rate structure shall follow the model below:
First specified number of gallons @ specified dollar amount per specified number of gallons;
Next specified number of gallons @ specified dollar amount per specified number of gallons;
Next specified number of gallons @ specified dollar amount per specified number of gallons.
Over specified number of gallons @ specified dollar amount per specified number of gallons.
SECTION TWO: All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION THREE: Due to the need to modify the existing rate structure for bulk rate outside
the City water usage, an emergency is hereby declared. This Ordinance shall be in effect from and
after its date of passage, subject to and as provided by applicable law.
