0318 . r r ORDINANCE NO. S\ ?� r AN ORDINANCE REPEALING ORDINANCE NO. 145, AMENDING ORDINANCE NO. 297, PROVIDING FOR THE DISPOSITION OF ABANDONED VEHICLES AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE C1TY COUNCIL OF THE CITY OF JACK- SONVILLE, ARKANSAS, that: SECTION 1. Ordinance No. 145 is hereby repealed and Section 1(c) of Ordinance No. 297 is hereby repealed. SECTION 2. When any vehicle of a type subject to registration under the laws of the State of Arkansas is found abandoned for a period of eight (8) days within the City, the same shall be stored and its owner located if possible. The person, firm, corporation or other entity on whose premises said abandoned vehicle is stored shall send a notice by registered mail to the last known address of the owner, notifying him that said vehicle is being held and that unless claimed within thirty (30) days will be sold at public sale to the highest bidder. Thirty (30) days after such notice has been given as described above, the holder of said vehicle and the peace officer who found said abandoned vehicle shall execute an affidavit stating that said vehicle has been found abandoned and is stored with said holder and that notice has been given, as pro- vided in this section, to the registered owner. Said affidavit shall describe the vehicle by make, year, model, serial number and body style, and set forth the retail market value of said vehicle. Said person, firm, corporation, county or city shall then apply to the nearest Revenue Office for title of said vehicle, submitting said affidavit and paying all license fees, title fees and taxes required by law. Upon receipt of a certificate of title on said vehicle and upon giving written notice to the National Automobile Theft Bureau in Dallas, Texas, said holder shall then sell said vehicle at the best available prices and after deducting all towing, storage and expense charges of what- ever nature, shall hold the balance of the purchase price for ninety (90) days from the sale thereof. After ninety (90) days from the date of sale, if the owner has not been located, or if no claim has been made on such vehicle, then the balance of the proceeds of said sale shall go to the State Highway Department n PGE #J g ©O OR3001k I ♦ . Page Two , General Fund, accompanied by a written notarized statement, itemizing the various deductions from the gross sales price of said vehicle, signed by the selling party. SECTION 3. Any inoperable motor vehicle heretofore or hereafter abandoned on private property of the person other than the owner of such motor vehicle, may be dismantled or destroyed by the owner of the property on which the vehicle is abandoned after securing an order of the County Court under the provisions of Arkansas Statutes Annotated, § 75-1034.1. SECTION 4. For the immediate preservation of the public peace, health and safety an emergency is declared to exist and this ordinance shall take effect immediately after its passage and approval.
