ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF JACKSONVILLE,
ARKANSAS TO DECLARE AN EMERGENCY IN TIMES OF WATER SHORTAGE
WITHIN THE CITY OF JACKSONVILLE, ¶ ARKANSAS; PROVIDING FOR RES-
TRICTIONS ON THE USE OF WATER DURING SUCH PERIODS OF EMERGENCY;
PROVIDING FOR A PENALTY FOR VIOLATION OF THE PROVISIONS HER EOF;
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, a temporary water shortage now exists in the City of Jack-
sonville, Arkansas pending completion of an expansion and repair of existing
facilities;
WHEREAS, such a water shortage may occur at some future time for
similar or other reasons;
NOW, THEREFORE, HE IT ORDAINED 13Y THE crry COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, that:
SECTION ONE. The Mayor is hereby vested with authority to declare
a state of emergency in times when a shortage of water exists within the City
water distribution system and he shall further have the authority to promulgate
rules and regulations concerning the use of water during such times which shall
have the full force and effect of law.
SECTION TWO. Any person, firm, corporation or other entity wilfully
violating the provisions hereof or any of the rules and regulations promulgated
hereunder shall be deemed guilty of a misdemeanor and may be fined not less
than $10.00 nor more than $25.00 for each offense or shall have water service
discontinued and the water meter removed, or may be subjected to both such
fine and discontinuance of water service.
SEC`FTON HR E . This ordinance being necessary for the immediate
preservation of the public safety, health and welfare, an emergency is hereby
declared to exist and this ordinance shall be in full force and effect immediately
after its passage.
