AN ORDINANCE VACATING, CLOSING AND ABANDONING A CERTAIN ALLRT
RUNNING NORTH AND SOUTH, ADJACENT 10 LOTS 1, 2, 3, 4, 6, 7, 9,
10, 11, and 12 INCLUSIVE, OF $LOCK.4, O*LWJILY ADDITION TO THE
CITY OF JACKSONVILLE, ARKANSAS, BETWEEN HICKORY STREET AND
EAST CENTER STREET; PROVIDING METRE RECORDATION OF THIS
ORDINANCE, AND FOR OTHER PURPOSES.
WHEREAS, a petition was duly filed with the City Council of the
City of Jacksonville, Arkansas, on the 27th day of April, 1971, asking
the City Council to vacate and abandon all that portion of the alley
lying between and adjacent to lots 1, 2, 3, 4, 6, 7, 9, 10, 11, and
12 inclusive of Block 4, Galloway Addition to Jacksonville, Arkansas,
which alley is designated on a plat of the Galloway Addition to said
city, now appearing of record in Plat Book 80, page 130, in the office
of the Recorder of Pulaski County, Arkansas, and
WHEREAS, after due notice as required by law, the City Council has,
at the time and place mentioned in the notice, heard all persons desiring
to be heard on the queation and has ascertained that the alley, or the
portion thereof, hereinbefore described, has heretofore been dedicated
to the public use as an alley herein described; has not been actually
used by the public generally for a period of at least five years sub-
sequent to the filing of the plat; that all owners of property abutting
upon that portion of the alley to be vacated have filed with the Council
their written consent to such abandonment; and that public interest and
welfare will not be adversely affected by abandonment of said allay.
HOW, THEREFORE, BE IT ORDUNED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE, AnKeessR:
SECTION I. The City of Jacksonville hereby releases, vacates and
abandons, all its rights, together with the rights of the public generally
in and to that portion of the alley designated as follows: that portion
of the alley lying between Lots 1, 2, 3, 4, 6, 7, 9, 10, 11, and 12 inclusive,
Block 4, Galloway Addition to Jacksonville, Arkansas. Said portion of said
alley is designated on the plat of the Galloway Addition to said city, now
appearing of record in Plat Book 80, Page 130, in the office of the
Recorder of Pulaski County, Arkansas.
SECTION II. A copy of the Ordinance dal certified by the City Clerk
shall be filed in the office of the Recorder of the County and recorded
in the deed records of the County.
