ORDINANCE :NO. _
AN ORDINANCE, AMENDING ORDINANCE NO. 208 TO ALLOW THE SALE OF
CAPS FOR USE IN GAP`'PISTOLS; DECLARING AN EMERGENCY TO EXIST {
AND FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, has determined
that a need exists to allow the sale of caps for use in cap
pistols and that an amendment to Ordinance No. 208 would accomp-
lish same;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JACK-
SONVILLE, ARKANSAS, that:
Section 1. That Section 1 of Ordinance No. 208, dated
November 21, 1968, shall be amended to read as follows:
"Section 1. No person, firm or corporation shall
sell at retail or wholesale within the City any squibs,
firecrackers, fireworks or the like; nor shall any per-
son, firm or corporation explode or discharge within
the City any squibs, firecrackers, fireworks or the
like and possession of a broken package of any of the
foregoing shall be prima facie evidence that the pos-
sessor thereof has been guilty of exploding or discharging
same; provided, however, that it shall not be unlawful
to sell caps for use in cap pistols or to explode or
discharge caps in cap pistols."
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed. If any part of this ordinance is
held to be invalid or unconstitutional by a court of competent
jurisdiction, such invalid part or section shall not affect the
validity of any of the remainder of this ordinance.
Section 3. That this Ordinance being necessary for the im-
mediate preservation of the public health, swfety, welfare and
morale of the citizens of the City of Jacksonville, Arkansas, an
emergency is hereby declared to exist and this Ordinance shall
have full force and effect immediately after its passage.
