AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THEPURCHASEOFA USEDSIDELOADER
GARBAGE TRUCK FOR THE SANITA TION DEPARTMENT; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES,
WHEREAS the Sanitation Department is in need of an additional garbage
truck for use in the City's automatedrefusecollection program; and,
WHEREAS, because funds are limited the Public Works Director has located a
used and fully reconditioned 2007 Autocar WXR that is available for purchase at a
reasonable rate and timeframe, with delivery and full reconditioning included. As a
result, this is an opportunity to purchase a compatible and useful garbage sideloader
at a reasonable cost to the Department to allow for continued enhancement of
automated collection for our citizens and an increase in the Sanitation Department
equipment's useful life cycles.
BE IT ORDAINED ANOENA CTEDBYTHE CITYCOUNCIL OFTHE CITY
OFJACKSONVILLE, ARKANSAS:
SECTION ONE; Competitive bidding for the purpose of obtaining a
reconditioned 2007 Autocar WXR Sideloader Garbage Hauler for the Jacksonville
Sanitation Department would be costly, non-productive, and time consuming,
making said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA § 14-58-303, competitive bidding
is hereby waived for the purpose of purchasing from Sanitation Fundmoniesa fully
reconditioned 2007 Autocar WXR, VIN 5VCDC6BE47H2O4366, for use with the
Sanitation Department's automated collection program. Authorization is hereby
given to the Mayor and/or his designated representative to execute necessary
documents with Alliance Refuse Trucks of Gilbert, Arizona, a supplier of above
referenced trucks that has agreed to accept a purchase price including
refurbishment, delivery, taxes, and DOT certification for the total sum of Ninety-nine
Thousand Dollars ($99,000.00). Anticipated delivery of the fully reconditioned 2007
autocar WXR Sideloader Garbage Hauler is to be within Thirty (30) days.
SECTION THREE; All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.

SECTION FOUR; Because passage of this Ordinance is necessary
for public health, peace, and safety of the citizens of Jacksonville, an emergency is
hereby declared. Thus, this Ordinance shall be in full force and effect immediately
upon and after passage.
