ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JACKSONVILLE, ARKANSAS, PROVIDING FOR
FIRE PROTECTION OUTSIDE THE CITY OF JACKSONVILLE AND PROVIDING
REGULATIONS FOR SAID PROTECTION; PROVIDING A SAVINGS CLAUSE; RE-
PEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.
WHEREAS, people residing just outside the city limits of
Jacksonville, Arkansas, are currently without adequate fire pro-
tection;
WHEREAS, the aforesaid people contribute to the general wel-
fare and well -being of the City of Jacksonville, Arkansas, and
have expressed a desire to contribute to the cost of extending
fire protection under certain conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JACK -
SONVILLE, ARKANSAS, that:
Section 1. From and after the passage and approval of this
ordinance any person, firm or corporation residing or existing
within close proximity of the City of Jacksonville, Arkansas,
shall have the right to apply for fire protection from the City
of Jacksonville, Arkansas, subject to the provisions herein con-
tained.
Section 2. Application for fire protection may be made by
submitting a deposit of $50.00 to the Office of the Mayor of
Jacksonville, Arkansas, and said application shall be subject to
the approval or disapproval of the Fire Chief or his authorized

representative. / Approval or disapproval shall be within the dis-
cretion of the Fire Chief or his authorized representative and
shall be made in the public interest, convenience and necessity.
Section 3. Any deposit monies retained by the City after
approval of any application authorized by this ordinance shall
be placed in the general fund of the City.( service is ren-

dered pursuant to an approved application and continued service
is desired, an additional application and deposit of $50.00 shall
be submitted for approval. Deposits made with any applications
which are disapproved shall be refunded to the applicant. An
applicant who subsequently desires to have service terminated
shall be entitled to a refund of his deposit.

Section 4.. Fire fighting equipment may be made available
for fire protection outside the City of Jacksonville pursuant to
an approved application therefor, and all applications shall con-
tain the following agreements of the applicant:
(a) That fire protection outside the City of Jackson-
ville shall be lim:.ted and subject to _higher priority fire pro-
tection. which shall be provided inside the City of Jacksonville,
Arkansas;
(b) That fire fighting equipment and personnel may be
recalled inside the City of Jacksonville when a need is determined
by the Chief of the Fire Department within said City for fire pro-
tection;
(c) That the City does not undertake to guarantee any
fire fighting results and offers only such reasonable equipment
as is consistent with conditions prevailing at the time; and
(d) That no claims of any kind or nature shall ever
be made by the applicant or his heirs, successors or assigns against
the City as a result of the services provided by City fire fight-
ing equipment and personnel and that the City shall be held harm-
less therefor.
Section 5. The provisions of this ordinance are intended to
be separate and severable, and the holding of any portion hereof
to be invalid, shall not affect the other portions.
Section 6, Ordinance 101 and all other ordinances incon-
sistent with the provisions of this ordinance shall be, and the
same are hereby repealed.
Section 7. That this ordinance being necessary for the
immediate preservation of the public health, safety, welfare and
morale of the citizens of the City of Jacksonville, Arkansas, an
emergency is hereby declared to exist and this ordinance shall
have full force and effect immediately after its passage.
