AN ORDINANCE VACATING AND ABANDONING A PORTION OF AN ALLEY
LYING IN BLOCK 18, TOWN OF JACKSONVILLF., PULL SKI COUNTY, ARKANSAS.
WHEREAS, A Petition was duly filed with the City Council of
the City of Jacksonville, Arkansas, on the 3rd day of September,
1965 asking the City Council to vacate and abandon the following
described real estate or any portion thereof, to -wit:
Beginning at the most Westerly corner of Lot 6.
Block 18, Town of Jacksonville, Pulaski County,
Arkansas; thence in a Northwesterly direction
along the Northeasterly line of East Main Street
for a distance of 16 feet to a.point which is the
most Southerly corner of Lot 7, in said Block 18;
thence Northeasterly along the Southeasterly lot
lines of Lots 7 through 12, inclusive, in said
Block 18 for a distance of 300 feet, more or less,
to a point on the Southwesterly line of Hickory
Street, said point being also the most Easterly
corner of Lot 12 in said Block 18; thence South-
easterly along the Southwesterly line of Hickory
Street for a distance of 16 feet to a point which
is the most Northerly corner of Lot 1, in said
Block 18; thence Southwesterly along the North-
westerly lot lines of Lots 1 through 6, inclus-
ive, in said Block 18, for a distance of 300 feet
to the point of beginning,
said alley being designated on a plat filed for record and now
appearing in the Office of the Circuit Clerk and Ex-- Officio Re-
corder of Pulaski County, Arkansas, in Plat Book 2, page 53.
WHEREAS, after due notice as required by law, the City Council
has at the time and place mentioned in said notice, heard all per-
sons desiring to be heard on the question, and has ascertained that
the portion of said alley hereinabove described has heretofore been
dedicated to the public use; that a portion of said alley was never
open to the public generally at any time and more specifically, has
not been used by the public generally for a period of at least five
years subsequent to the filing of the plat; that all of the owners
of the property abutting upon the portion of said alley to be vacated
w
have filed with the Council their consent to such abandonment;
that public interest or welfare will not be adversely affected
by the abandonment of the portion of said alley hereinafter de-
scribed.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION 1: The City of Jacksonville, Arkansas hereby re-
leases, vacates, and abandons all of its right together with the
rights of the public generally, in and to the following described
land, to -wit:
The East 4 feet which is adjacent to and abuts Lots
4, 5, 6, and the South 5 feet of Lot 3, Block 18,
Town of Jacksonville, Pulaski County, Arkansas, and .
being a portion of the following described alley,
to -wit:
Beginning at the most Westerly corner of Lot 6, Block
18, Town of Jacksonville, Pulaski County, Arkansas;
thence in a Northwesterly direction along the North-
easterly line of East Main Street for a distance of
16 feet to a point which is the most Southerly corner
of Lot 7, in said Block 18; thence Northeasterly a-
long the Southeasterly lot lines of Lots 7 through 12,
:inclusive, in said Block 18 for a distance of 300 feet,
more or less, to a point on the Southwesterly line of
Hickory Street, said point being also the most Easter-
ly corner of Lot 12 in said Block 18; thence South-
easterly along the Southwesterly line of Hickory Street
for a distance of 16 feet to a paint which is the most
Northerly corner of Lot 1, in said Block 18; thence
Southwesterly along the Northwesterly lot lines of Lots
1 through 6, inclusive, in said Block 18, for a dist-
ance of 300 feet to the point of beginning.
SECTION 2: A copy of this ordinance duly certified by the
Clerk is being filed in the office of the Circuit Clerk and Re-
corder of Pulaski County, Arkansas, and recorded in the deed re-
cords of said County.
SECTION 3: This ordinance sha]1 take effect and be in force
from and after the date of its passage.
