0144 ORDINANCE NO. 144 AN ORDINANCE ACCEPTING THE RECOMMENDATION OF THE JACKSONVILLE PARKS AND RECREATION COMMISSION RESPECTING THE ESTABLISHING OF RULES AND REGULATIONS FOR THE JACKSONVILLE MUNICIPAL PARKS: DECLARING AN EMER_ GENCY TO EXIST: AND FOR OTHER PURPOSES. WHEREAS, Ordinance Number 118 and of the City Council of the City of Jacksonville, Arkansas, authorized the purchase of cer- tain real property to be used exclusively as municipally owned public parks within the city limits of the City of Jacksonville, Arkansas; and WHEREAS, Ordinance Number 119 of the City Council of the City of Jacksonville, Arkansas created and established the Parks and Recreation Commission of the City of Jacksonville, Arkansas; and delegated to the said Parks and Recreation Commission the responsibility of managing, operating and regulating the activities and uses within the said muni- cipally owned public parks within the city of Jacksonville, Arkansas; and WHEREAS, the Parks and Recreation Commission of Jacksonville has submitted to the City Council a report of recommendations, in the form of the Resolution herinafter referred to, respecting the establishment of rules and regulations for the care, maintenance, protection and use of the Jacksonville Municipal Parks; and WHEREAS, said report was duly adopted by the Commission as required by law; and WHEREAS, the public health, welfare, morals and safety of the citizens of Jacksonville will be protected, promoted and benefitted by the adoption of this ordinance, as is more fully set forth in Section hereof; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION I. A Resolution adopted by the Jacksonville Parks and Recreation Commission on August 20 , 1963, entitled, Resolution of the Jacksonville Parks and Recreation Commission Recom- mending the Establishment of Rules and Regulations for the Jacksonville Municipal Parks, is hereby accepted as the report and recommendations of said Commission respecting the matters therein set forth. SECTION II. That from and after the passage of this Ordinance the following be and the same shall be known as the Rules and Regulations of the Jacksonville Municipal Parks ands shall have the same force and effect as ttger laws of this City: A. When sighs are erected giving notice therof, it shall be unlawful for any person to drive or cause to be driven any truck larger than three- ! _ . ., . fourths of a ton, whether loaded or unloaded, and/or any tractor on any of the roads within the public parks of this city unless said vehicle is on a delivery to or from said park, or is engaged in work actnat1y being done with the said park. B. When signs are erected giving notice thereof, it shall be unlaw- ful for any person to drive or cause to be driven any motor vehicle at a speed faster than fifteen (lSNPH) miles per hour on any roads within the public park, unless said vehicle is an emergency vehicle on a mission to or from said park. C. It shall be unlawful for any person to cut, pull, tear or otherwise desplace or disturb any trees, shrubs, vines, ferns, wild flowers or other vegetation, wheter wild or cultivated, which may now or hereafter grow or be found within the public parks in the city. The terms of this section shall not be construed to apply to any landscape gardener or other person duly authorized by the Parks and Recreation Commission to improve or Beautify said parks by the trans- plantation or rmoval of any tree, vine, shrup or flower contained therein. A. No person shall discharge any firearms or fireworks in any muni- cipal park within the city without authority of the Parks and = Recreation Commission having been first obtained. E. No person shall write upon, or mark, or deface in any manner, or use in any improper way any water closet, park, seat, fence or build- ing, or anything pertaining the city park or parks. F. No persons shall throw, or drop stones, sticks or rubbish of any kind into the lakes or ponds within the city park or parks, nor bathe nor wade therein. G. No person shall chase, shoot at, set snares for, or catch or injure any rabbits, squirrels, birds, fish or any otheranimnis, wild or tame, belonging to said park or parks or kept therein. H. No person shall paste, affix or inscribe any handbill, poster, card, devise, or inscriptuon, or advertisement upon or against any building, tree, fence, structure or property of any city park, or dis- tribute the same therein. I. No person shil set up any table or booth for the sale of, nor peddle any articles whatsoever, within the city park without the authority so to do having been first obtain from the Parks and Recreation Commiss- ion. No erson shall render any music vocal or instrumental or p Y a + deliver any oration, speech, address or lecture, in said park or parks without a permit for such purpose having been first obtained from the Parks and Recreation Commission. K. No person or persons shall park a motor vehicle, loiter or assemble, for any purpose whatsoeverm between the hours of ten o'clock P.M. and eight o'clock A.M. in the public park or parks of this city. This section shall not be construed to prohibit the attendance at ball games, private parties, public gatherings and all other functions for which permits have been first obtained from and authorized by the Parks and Recreation Commission, Which were begun prior to either eight o'clock in the morning or ten o'clock in the evening. SECTION III. Any person violatnig the provisions of this Ordinance, or any section thereof, shad upon cinviction be deemed guilty of a misdeameanor and shall be fined in any sum not less than fifteen ($15.00) Dollars, nor more than one hundred ($100.00) Dollars. SECTION IV. All Ordinances or parts of Ordinances in conflict herewith are hereby declared repealed and /or amended to the extent of their conflict herewith. SECTION V. That in the event any part of this Ordinance is held to be uncontitutional, interpreted as invalid by any Court of competent jurisdiction, or is specifiraliy repealed by subsequent ordiaance, such action shall not affect the validity of any other section hereof. SECTION VI. That the rules and regulations of the public parks of the City of Jacksonville, Arkansas shall not be limited to, but shall be enlarged by the aformmentioned and set forth. That all acts or omissions which constitute crimes within any other area of Jackson- ville, shall be deemed a crime within the cinfines of the public parks of said city. SECTION VII. This Ordinance being necessary for the immediate preservation, improvement of the public peace, health, safety and morals of the city of Jacksonville, Arkansas, an emergency is herebt declared to exisr; and this Ordinance shall be in full force and effect from and after its passage and apprival.
