AN ORDINANCE ACCEPTING THE RECOMMENDATION
„° OF THE JACKSONVILLE PLANNING COMMISSION
v , N RESPECTING THE ESTABLLSHMENT OF THE MASTER
STREET PLAN OF THE JACKSONVILLE PLANNING AREA,
AND RELATED MATTERS; ESTABLISHING SAID PLAN;
AND FOR OTHER PURPOSES.
WHEREAS, Act 186 of the 1957 General. Assembly of theState of
Arkansas authorizes municipalities to prepare and adopt a master street
plan; and
WHEREAS, the City of Jacksonville is in urgent need of a compre-
hensive and forward looking plan for adoption as a statement of intent con-
cerning the growth and function of its street and highway pattern as a frame-
work and guide in further planning studies, and as a means of securing for
the City and its citizens the benefits of an official plan; and,
WHEREAS, the Jacksonville Planning Commission has submitted to
the City Council a report of recommendations, in the form of the resolution
hereinafter referred to, respecting the establishment of the Master Street
Plan for the Jacksonville Planning Area; and,
WHEREAS, said report was adopted after due notice and public
hearing as required by law; and
WHEREAS, the public health, welfare, morals, and safety of the _ _
citizens of Jacksonville will be protected, promoted and benefited by the
adoption of this ordinance, as is more fully set forth in Section 3 hereof;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS:
Section 1. Acceptance of the Report. A resolution adopted by the
Jacksonville Planning Commission on March 5, 1963 entitled
"A Resolution Approving and Adopting the Master Street Plan of the
Jacksonville Planning Area and Recommending Said Plan to the City Council '
of the City of Jacksonville, Arkansas, " is hereby accepted as the report and
recommendation of said Commission respecting the matters therein set forth.
Section 2. Adoption of the Plan. There is hereby adopted as panraf
part of the Jacksonville Municipal Plan, a Master Street Plan, which plan is
shown on a map bearing the title "Master Street Plan, City of Jacksonville,
Pulaski County, Arkansas" and further identified by the signature of the
chairman of the Jacksonville Planning Commission duly attested by the
Secretary of said Commission, and by the signature of the Mayor of the
• City of Jacksonville and duly attested by the City Clerk, which map accompan-
ies this ordinance. Said map and all explanatory matter thereon are hereby
adopted and made a part of this ordinance, as fully as if described herein at
length.
Said map together with such other maps, charts, documents,
ordinances, or orders as may from time to time be prepared and adopted,
all pursuant to Act 186 of 1957 of the General Assembly of the State of
Arkansas, shall be known and may be cited as the "Master Street Plan of the
Jacksonville Planning Area."
Section 3. Purpose . The major street locations and classifications
as herein set forth are made in accordance with a comprehensive plan in

order that traffic and circulation of people and goods may be convenient; that
safety from traffic hazards and other dangers may be secured; that congestion
in the public streets may be lessened or avoided; that the process of development
may be efficient and economical.; and that the public safety, morals, order, con-
venience, prosperity and general welfare of the citizens may be promoted. The
plan is made with reasonable regard for existing conditions, the future traffic
anticipated along each route, the most desirable location and character for
which each facility may be adapted, and the conservation of property values
throughout the City.
Section 4. Establishment of Classification. For the purpose of this
ordinance, the streets in the Jacksonville Planning Area are divided into classi-
fications designated as follows:
Al Freeway
A2 Freeway
A3 Freeway
131 Expressway
B2 Expressway
B3 Expressway
Cl Major Thorofare
C2 Major Thorofare
C3 Major Thorofare
Di Collector
D2 Collector
D3 Collector
The above major streets and the locations of said streets are hereby
established as shown on the plan documents described in Section 2 of this
ordinance.
Section 4. Planning Specifications. The streets shown on the plan
exist or shall be planned according to the following specifications:
1. Al Freeway shall include any existing or approved project
under the Federal. Aid Highway Act of 1956 having right -of -way
basically established and engineered, and may include a road
not so designated but built to such design standards; and shall
have a right -of -way width as determined by the Arkansas
Highway Department, (generally 300 feet or greater).
2. A2 Freeway shall include any approved project under the
Federal Aid Highway Act of 1956, having an established align-
ment; and shall have a right -of -way width as determined by the
Arkansas State Highway Department, (generally 300 feet or
greater).
3. A3 Freeway shall include any future extension to a freeway
of another classification, shall be located on a general alignment,
and shall have a right- of-way width as determined by the Arkansas
State Highway Department, (generally 300 feet or greater).
4. 131 Expressway shall include any existing or approved project
having an established and engineered alignment and shall have a
right -of -way width of 150 feet or greater.
5. B2 Expressway, shall include any proposed project having an
established alignment, and shall have a right -of -way width of 150 feet
or greater.
6. B3 Expressway shall include any future extension to an ex-
pressway of another classification, shall be located on a general
alignment and shall have a right -of -way width of 150 feet or greater.

7. C1 Major Thorofare shall include any existing or approved street
on an established or engineered alignment, and shall have a right -of -way
of 80 feet or greater.
8. C2. Major Thorofare shall include any proposed street on an
established alignment, and shall have a right -of -way width of 80
feet or greater.
9. C3 Major Thorofare shall include any future extension to a thoro- �.
fare of another classification, shall be located on a general alignment .
and shall have a right -of -way width of 80 feet or greater.
10. D1 Collector shall include any street of lesser standards than free-
way. expressway, or major thorofare shall be an existing street or
approved project having an established or engineered alignment, and
shall have a right -of -way width of 60 feet or greater.
11. D2 Collector shall incl ude any street proposed to be built or
widened to the specifications of a D1 Collector, shall. have a general
alignment and shall have a right -of -way width of 60 feet or greater.

Section 5. Authority, Jurisdiction and Enforcement. Any sub-
divider of land within the Planning Area of the Jacksonville Planning Commission,
who proposes to make or have made a subdivision of said land, shall conform
to this plan by indicating, on any plats or drawings submitted to said commission
for its consideration, any major street identified on this plan which traverses
or abuts the said propoerty, and shall plat said facility to the width and in the
location determined by said commission, and shall dedicate so much of said
right -of -way as is not in excess of 80 feet in width. Any right -of -way require-
ment in excess of 80 feet in width which is not dedicated at that time shall be
reserved for acquisition by the appropriate public body at a later date.
Whenever the Jacksonville Planning Commission is presented with a
request for consideration of a plat involving the widening of any mapped exist-
ing facility, or an A2 Freeway, B2 Expressway, C2 Major Thorofare, or
D2 Collector said Commission shall determine, with the assistance of the
City, the exact location and extent of right -of -way necessary for the provision
of said facility, and shall require in conjunction with the approval of the plat, the
the dedication or reservation of the right -of -way as stipulated above.
Whenever the Jacksonville Planning Commission is presented with a
request for consideration of a plat involving an A3 Freeway, B3 Expressway,
C3 Major Thorofare, or D3 Collector, said Commission, with the assistance
of the City, shall reconsider the general route shown on this plan and either
determine the definite location and extent of right -of -way in the indicated lo-
cation and shall require the dedication or reservation thereof as above, or shall
recommend for consideration by this Council a proposal to alter the location
by amendment to this plan.
The City shall not issue building permits for any structure on any
lot or parcel which is traversed by or abuts any indicated major street
facility unless it has first determined that the proposed structure would not
lie within the proposed bounds of said facility, or unless otherwise authorized
under the provisions of Section 2, Paragraph g. of said Act 186. Nothing
herein contained, however, shall be construed to deny a permit for the use of
such lot or parcel for purposes not involving the construction or relocation
of buildings.
This plan shall be duly considered prior to action on any matter
related thereto which comes before the Jacksonville Planning Commission,
the City Council, or any of the departments, agencies, boards or commis-
sions of this city.

Section 6. Recording. A copy of this ordinance, together with the niap
referred to herein, shall be filed in the Office of the Recorder of Pulaski County
as required by Act 186 of 1957 of the General Assembly of the State of Arkansas.
Section 7. Severability. If any section, clause, paragraph, provision
or portion of this ordinance or plan shall be held invalid or unconstitutional by
any court of competent jurisdiction, such holding shall not affect any other
section, clause, paragraph, provision or portion of this ordinance or plan.
Section 8. Effective Date. This ordinance shall be in full force and
effect from and after its passage, approval and filing. ,
