AN ORDINANCE VACATING AND ABANDONING AN ALLEY AS FLAWED, BISECT*
ING BLOCK ONE (1), GALLOWAYS ADDITION TO THE TOWN OF JACKSONVILLE,
PULASKI COUNTY, ARKANSAS, SAID ALLEY BEING SIXTEEN (16) FEET IN
WIDTH AND LOCATED NORTH OF THE NORTH LINE OF CENTER STREET AND SOUTH
OF THE SOUTH LINE OF GALLOWAY STREET, IN THE CITY OF JACKSONVILLE,
ARKANSAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
WHEREAS, a Petition was duly filed with the City Council of the City of
Jacksonville, Arkansas on the 5th day of July, 1956, asking the City
Council to vacate and abandon all that portion of an alley described as follows:
A strip of land designated as an alley, being 16 feet in width and
extending from the North line of Center Street to the South line of
Galloway Street, Block One (1), Galloway's Addition to the Town of
Jacksonville, as shown by plat which appears of record In the office
of the Circuit Clerk and Ex- officio Recorder of Pulaski County, Ark-
ansas, in Deed Book 80 at page 130.
WHEREAS, after due notice, as required by law, the Council has, at the time
and place mentioned in the notice, heard all persons desiring to be heard on the
question and has ascertained that the alley hereinabove described has heretofore
been dedicated to the public for use as an alley; that it has not been used by
the public generally for a period of at least five (5) years subsequent to the
filing of said plat and actually has never been opened for public use at any time;
that all of the owners of the property abuting upon said alley have filed with the
CotJnoil their written consent to such abandonment; that public interests nd wel-
fare will not be adversely affected by the abandonment o2 said alley .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF T HE CITY OF JACKSCNVILLE
ARKANSAS:
SECTION 1, The City of Jacksonville, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the public generally, in and
to that certain alley described as follows:
A strip of land designated as an alley, being 16 feet in width and ex-
tending from the North line of Center Street to the South line of
Galloway Street, Block One (1), Galloway's Addition to the Town of
Jacksonville as shown by Plat which appears on record in the office of
the Circuit ' and Ex- officio Recorder of Pulaski County, Arkansas,
in Deed Book 80 at Page 130.
SECTION '%.. A copy of this Ordinance, duly certified by the City Clerk shall
be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded
in the Deed Records of said County.
SECTION 3. This Ordinance shall take effect and be in force and effect from
and after its passage.
