95 NOV 13.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 1995 7:00 P.M. - 8:10 P.M. OPENING REMARKS: Chairman Brannen opened the meeting and expressed appreciation for those in attendance. ROLL CALL: Commissioners: Rudy Reid, Connie Foster, Jim Dornblaser, Lester Piggee, Bart Gray, and Jack Patton answered ROLL CALL. Chairman Brannen answered ROLL CALL and declared a quorum. PRESENT seven (7), ABSENT (1). Others present for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Davitt, Engineering Receptionist Marci Wilson, and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Dornblaser moved, seconded by Commissioner Piggee that the minutes of the October 9, 1995 Regular Planning Commission and the minutes of the October 30, 1005 Special Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: No requests were submitted. REQUEST TO APPROVE BUILDING PERMITS: Expansion for the Hope Lutheran Church The building permit was presented by Chairman Brannen. City Engineer Reel stated that the request fits the perimeters of the present zoning and that parking requirements are met for the proposed family life center to be constructed on the west side of the building toward Braden St. He pointed out that the fire marshall has not looked over the plans at this time. Commissioner Gray moved, seconded by Commissioner Dornblaser to approve the building permit of the Hope Lutheran Church, 1801 Braden Street as requested. MOTION CARRIED. A request was submitted by Holiday Inn but there was not a representative to address the Commission. The item was deferred by Chairman Brannen to be addressed as the last item of business. REQUEST TO APPROVE PLATS: Stonewall Phase VII, Drainage Plans (Jim Green) Chairman Brannen presented the item of business and asked if the retention pond will be covered. Mr. Tommy Bond voiced that it would not, that it is a swale and at the maximum point it is 3.3 ft. deep and will be easy to mow. He added that it will hold water only when it rains. He stated that it will accomplish the request from the Planning Commission that the development not impact the current drainage in the area. Discussion began regarding the request by the Planning Commission to install a privacy fence along Loop Road. Mr. Bond related that a privacy fence will add additional cost to the sale of lots in the development. Chairman Brannen requested that the item involving the approval of the drainage concerns be resolved before moving on to other requests from the Planning Commission. City Engineer Reel requested that drop inlets and an 18' pipe be installed at the curve in the western most street at the south side of lot 508F in order to divert the flow of water from Berkshire Drive and direct it toward the drainage retention basin and then into the ditch. He discussed the desired performance of the retention basin citing the effects of a retention basin near the Air Force Base. Mr. Bond related that with regard to the drainage request, he did not see a problem. Mr. Andy Timer expressed concerns regarding the retention basin as an earthen ditch and inquired as to the responsibility of its future maintenance. City Engineer Reel related that other earthen structures located in Northwood Acres and Pennpointe Subdivisions have not presented any major problems. He stated that if properly constructed he did not feel there would be any erosion type problems, adding that this is amoung one of the first times such a structure has been addressed by the Planning Commission. In response to a question posed by Chairman Brannen, City Engineer Reel related that maintenance responsibility can be dealt with in the bill of assurance by the property owners or dedicated to and maintained by the City, adding that nothing definite has been decided. Commissioner Gray reminded the Commission that until it is dedicated and accepted by the City the property owner is responsible for the maintenance. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING NOVEMBER 13, 1995 7:00 P.M. - 8:10 P.M. City Engineer Reel related that drainage requests have been addressed. Referring to a letter presented to the Commission he stated that he has requested a privacy fence be constructed along the right-of-way line of Loop Road. He said that he felt this would offer control of back access to lots and act as a screen along Loop Road. He then requested that the Bill of Assurance state that no access to Berkshire Drive be allowed on an individual basis. Discussion ensued as to location of the privacy fence with regard to projected future widening of Loop Road. Commissioner Gray noted different developments in the City which have used privacy fences as a method of screening. Further discussion ensued regarding types of material that can be used to construct a fence and consideration arose for constructing a fence along Berkshire Drive also. Information regarding other areas using privacy fences for separation or screening was then discussed. Mr. Andy Timer stated that he would like to register his support in favor of a privacy fence along Loop Road and Berkshire Drive because he felt it would be estheticlly beneficial. He then expressed concerns regarding traffic from the proposed development entering onto Berkshire Drive, which he felt is already very congested at times. Mr. Bond expressed his concerns regarding the additional cost of constructing a privacy fence, which would be incurred in the lot sale price. Commissioner Dornblaser stated that he felt lot costs to be secondary to the justification for the fence. Discussion ensued regarding voting on the separate issues and reasons for consideration regarding a privacy fence for Berkshire Drive. A resident from the area suggested that a hedge row be used as a noise barrier. Further consideration for maintenance of the hedges was discussed as well as the uniformity of privacy fencing. Discussion regarding each request ensued the following motions were made. Commissioner Foster moved that Phase VII of Stonewall be accepted with a privacy fence going down Berkshire as related to the phase. The motion died for lack of a second. Commissioner Gray moved, seconded by Commissioner Dornblaser that the drainage plan of Stonewall Phase VII, be accepted as presented. MOTION CARRIED. Commissioner Gray voiced that he assumed that item four (4) as presented by City Engineer Reel would be included in the motion. It was pointed out by the City Attorney that items one, two and three are not addressed in this motion. Commissioner Dornblaser re-opened the requirement issue of a privacy fence along Loop Road and Berkshire Drive. He commented on the construction of a privacy fence or the hedge row alternative. He asked for recommendations from the Engineering Department. Commissioner Piggee questioned if the Bill of Assurance could specify types of material used to construct the privacy fence. City Engineer Reel cited an example regarding specifications requested in building a bridge in Johnson Park six months ago. He stated that penetrated lumber with a forty (40) year ground contact guarantee was used and that repairs are now being sought to correct a variety of problems with the lumber. He stated that it would be hard to cover the variables with regard to using lumber. Discussion ensued as to the maintenance responsibility, Bill of Assurance capabilities and material request. Commissioner Foster moved, seconded by Commissioner Reid that a privacy fence be required on Berkshire and Loop Road with regard to Stonewall Phase VII, asking that the Bill of Assurance state that the property owner will be responsible for the maintenance of said fence. MOTION CARRIED. Developer Jim Green suggested that the Commission deal with the issue of fencing at a later date pointing out that the drainage issue was what he brought before the Commission. The motion stood as passed. A discussion ensued as to the time the fence should be constructed, before or after construction of the dwelling planned for the lot. Commissioner Foster moved, seconded by Commissioner Gray that the Bill of Assurance state that no access be allowed to Berkshire or Loop Road on an individual basis. MOTION CARRIED. b. REVISION PLAT: Preliminary Fair Oaks Subdivision Petitioner Jerry Smith Mr. Tommy Bond remarked that the culdesac was taken out of the previous plat and some lots taken out. Commissioner Gray moved, seconded by Commissioner Piggee to approve the Revised Preliminary Plat of Fair Oaks Subdivision with the stipulation that Christy Lane be renamed and that lots 1F and 47F maintain no excess to Main Street. MOTION CARRIED. The building permit with regard to Holiday Inn was held in abeyance until the December meeting of the Planning Commission.
