94 FEB 14.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 1994 7:00 P.M. - 7:55 P.M. OPENING REMARKS: Chairman Elliott expressed appreciation for those in attendance and requested roll call. ROLL CALL: Commissioners: Rudy Reid, Connie Foster, Jim Dornblaser, Tad Green, Lester Piggee and Jack Patton answered ROLL CALL. Chairman Elliott also answered ROLL CALL and declared a quorum. PRESENT EIGHT (8), ABSENT (1). Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings, Computer Tech /Receptionist of the Engineering Department Mylissa Founds, Mr. Paul Payne, and Mr. Byron McKimmey petitioner representing the Deer Creek Subdivision item on the agenda. PRESENTATION OF PLAQUES: Mr. Bart Gray Jr. and Mr. Paul Payne Chairman Gray presented a plaque to Mr. Paul Payne expressing appreciation for his excellent work on the Planning Commission and the Board of Adjustment from 1991 to 1994. Mr. Gray was not present to receive his plaque. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting/January 10, 1994 Commissioner Dornblaser moved, seconded by Commissioner Piggee that the minutes of January 4, 1994 be APPROVED. MOTION CARRIED. It was pointed out by Mr. Dornblaser that an item mentioned in the minutes regarding the future development along Main Street was not on the agenda and requested that it be discussed at the appropriate time during the meeting. It was requested that the item be placed on the next agenda (March) along with a request to City Engineer Reel to contact Metroplan and have a representative present to discuss Main Street building restrictions and development and advise the Commission. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were submitted. REQUESTS TO APPROVE BUILDING PERMITS: None were submitted. REQUESTS TO APPROVE PLATS: Preliminary Plat/Deer Creek Subdivision Outside the City Chairman Elliott read the letter from Mr. McKimmey regarding two variances included in the Preliminary Plat Approval request; Lot 47 is requested with a 15 ft. front setback and a culdesac which 1 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 1994 7:00 P.M. - 7:55 P.M. exceeds the five hundred foot maximum distance permitted in the Jacksonville Municipal Code. City Engineer Reel explained that he desires that the lot requested for a 15 ft. front setback meet the 25 ft. front setback requirement and that the long culdesac be allowed. He pointed out that the County will see the plat after the Jacksonville Planning Commission deals with it. He related that the County will look after the streets, that the water is served by the City of North Little Rock and sewer by the sewer approval district in Gravel Ridge. He said that basically, the Commission is looking at street design and geometry of the culdesac as it relates to the subdivision. There was discussion regarding emergency vehicles in relation to the length of the culdesac. City Engineer Reel pointed out that proper radius of the culdesac would take care of a situation with normal emergency equipment. He said that the rules and regulations used in the subdivision development were set in the early sixties by the University of Arkansas for small cities establishing Planning Commissions. It was the consensus of the group that the culdesac is actually about 800 feet making a variance of 300 feet requested according to the Jacksonville Municipal Code. Mr. McKimmey related that the plat is the last development of Green Valley Development. Engineer Reel said that the parcel is the last usable property in the area and that the design of the culdesac is proposed due to the terrain. It was pointed out by Commissioner Dornblaser that it has been the practice to mark lots falling within the flood plain with an F and suggested that lots 24, 25 and 26 be designated in the same way. The following motion was made expressing concerns of the commission regarding culdesac length. Commissioner Dornblaser moved, seconded by Commissioner Foster that the PRELIMINARY PLAT of DEER CREEK SUBDIVISION be APPROVED with the following stipulations: (1) that the culdesac length be approved as requested and (2) that the fifteen (15) ft. front setback for 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 1994 7:00 P.M.-7:55 P.M. lot 47 be denied, (3) that lots 24, 25, and 26 be marked with an F with concerns expressed regarding the length of the culdesac. Commissioner Patton expressed concerns regarding the subdivision not having but one ingress and egress. MOTION CARRIED. There were no votes opposing the plat. DISCUSSION: Annexation of Property between Jacksonville and Sherwood City Engineer Reel voiced that efforts by the Chairman of the Planning Commission of Sherwood, the Mayor and property owners, who requested to be annexed to the City of Sherwood in the area along Highway 67/167, seem to have made it a moot issue with regard to Jacksonville's requesting the annexation of certain properties into the city. He said that Mr. Dupree, who owns some property off Lucy Lane, does not want to be a part of Sherwood and that the City of Sherwood has agreed to revise the legal description granting freedom to the City of Jacksonville to annex the property. He said that two other parcels indicated on a map before the commission should be considered for annexation into the city and that a parcel along Loop Road should be included in the effort. There was general discussion regarding the annexation process and areas that might be annexed into the City of Jacksonville. It was the consensus of the Planning Commission that City Engineer Reel compile the data needed to present the parcels to the City Council for annexation into the city. DISCUSSION: MAIN STREET DEVELOPMENT AND BUILDING RESTRICTIONS Commissioner Dornblaser voiced his concerns regarding Main Street and the possibility of imposing building restrictions with regard to its development. City Attorney Bamburg pointed out that some restrictions can be placed, that some things would have to be "Grandfathered" in under present restrictions and related that the task will not be an easy one. After a general discussion the consensus of the Planning Commission was that City Engineer Reel contact Metroplan and Main Street Arkansas requesting that a representative meet with the Planning Commission with regard to guidelines for improving the area. 3 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 1994 7:00 P.M. - 7:55 P.M. It was suggested that a committee be formed to bring recommendations to the Planning Commission after the presentation at the next regular meeting.
