93 JULY 12.docCITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 12, 1993 7:00 P.M. - 8.40 P.M. OPENING REMARKS: Chairman Bart Gray Jr. opened the meeting, welcomed those in attendance and requested ROLL CALL. ROLL CALL: Commissioners: Rudy Reid, Connie Foster, Jim Dornblaser, Art Brannen, Tad Green, Lester Piggee, Paul Payne and Jack Patton, were present. Chairman Gray also answered ROLL CALL and declared a quorum. PRESENT nine (9). ABSENT (0). Others in attendance for the meeting were Engineer Duane Reel, Code Enforcement Officer Wayne Cox, Computer Technician Mylissa Founds and Receptionist of the Engineering Department Terri Hartley, petitioner and interested citizens. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of June 14, 1993 Commissioner Brannen moved, seconded by Commissioner Patton that the minutes of the June 14, 1993 Planning Commission Meeting be APPROVED with the following addition: “Commissioner Dornblaser was present and Commissioner Piggee was absent." MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: A verbal request was submitted by Mr. Fred West for the rezoning of Lots 3, 4, 9 & 10 Grace Brown Addition (Revised) (general location: on James Street between Poplar & Vine Streets). Commissioner Piggee moved, seconded by Commissioner Dornblaser that a public hearing be set for 7:00 p.m. at the next Regular Planning Commission Meeting regarding the rezoning of Lots 3, 4, 9 & 10, Grace Brown Addition (Revised) contingent upon Mr. West presenting a $50.00 advertising fee at sometime during the present Planning Commission Meeting. MOTION CARRIED. REQUEST TO APPROVE BUILDING PERMITS: 1. 804 Trickey Lane / Petitioner: Joe Lehman Mr. Lehman was not present. City Engineer Duane Reel voiced that he had told Mr. Lehman that he would represent him at the meeting. He said that the request of Mr. Lehman is to construct a garage in which to park his truck, boat, camper etc. He related that Mr. Lehman owns the lot, which joins the lot on which his home is located, and explained that they were not purchased a the same time. Chairman Gray questioned whether the parcel had been before the commission previously for platting or subdividing. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 12, 1993 7:00 P.M. - 8.40 P.M. City Engineer Reel related that it had not, that it is one of two lots owned by Mr. Lehman. Commissioner Dornblaser questioned the proposed use of the garage. City Engineer Reel voiced that it is to store his vehicles and boats, mentioning items related to his work as well. Commissioner Payne related that the parcels are legally described by meets and bounds. Commissioner Patton related that he felt Mr. Lehman should attend the meeting to answer the questions of the Commission. Commissioner Patton moved, seconded by Commissioner Brannen that the building request of Joe Lehman for 804 Trickey Lane be tabled until Mr. Lehman is present to share his intentions regarding the building permit request. MOTION CARRIED. 2. FIRST JACKSONVILLE BANK/RECONSTRUCTION Alderman Larry Wilson, President of the First Jacksonville Bank, represented the item before the Planning Commission. Chairman Gray and Mr. Rudy Reid voiced that they would not enter into any of the voting process due to a conflict of interest. Mr. Wilson voiced that there are a possible 128 parking spaces which are ample according to city codes. He related that the building will be a three-story one and requested a waiver of seventy feet with regard to height of the building. There were comments from several of the Commissioners with regard to the project and how it would enhance the downtown area of the city. Commissioner Brannen moved, seconded by Commissioner Dornblaser that the reconstruction of the First Jacksonville Bank be APPROVED with a waiver of seventy (70) feet with regard to height. MOTION CARRIED by unanimous ROLL CALL vote. REQEST TO APPROVE PLATS: a. FINAL PLAT / Tara Mount Subdivision Lots 88-97 It was pointed out that this will be the last phase of Tara Mount Subdivision. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 12, 1993 7:00 P.M. - 8.40 P.M. City Engineer Reel said that the subdivision is complete except for the letters of approval from Water and Wastewater Utilities. Mr. Tim Lemons pointed out on a plat of Tara Mount Subdivision, presented at the meeting, that lots 95F and 96F are not included He explained FHA regulations regarding lots in the flood zone and how it related to subdivision approval by that agency. He said that when someone purchases Lot 95, 95F will be deeded to that person and likewise with 96 and 96F. Commissioner Patton moved, seconded by Commissioner Piggee that the FINAL PLAT of Tara Mount Subdivision as presented a the Planning Commission Meeting (without 95F and 96F indicated on the Map) be APPROVED with the stipulation that letters of approval from the Water and Wastewater utilities be received. MOTION CARRIED. b. FINAL PLAT / Jenny Lynn Subdivision City Engineer Reel said that the subdivision is complete except for the asphalt being laid, which is scheduled for Thursday, July 15, 1993, and receipt of letters of approval from the Water and Wastewater Utility after their meeting in the month of July. It was pointed out by Mr. Green that the square footage has been increased in the Bill of Assurance for lots and one (1) through six (6) to 1300, for lots 7, 8 and 9 to 1200 and for lots 10, 11 and 12 to 1100, and that driveways be built to accommodate two cars or 18 feet wide. It was pointed out that the fifteen foot sideyard setback accommodates two lots, one and six, which will face Mandy Cove, and that the 25 foot setback along Northeastern Avenue relates to all other lots in the subdivision. Commissioner Dornblaser moved, seconded by Commissioner Brannen that the FINAL PLAT of Jenny Lynn Subdivision be APPROVED with the stipulation that letters of approval be received from the Water and Wastewater Utility, that the street be completed to the satisfaction of the City Engineer and with lots 1 through 6 facing Mandy Cove. MOTION CARRIED. Commissioner Patton left the meeting at approximately 7:40 p.m. 3. FINAL PLAT / Rebsamen Medical Subdivision # 1 City Engineer Reel related that the six lots in the subdivision all face John Harden Drive and are immediately south of the property where Robbie Walker's Physical Therapy Office is located. It was pointed out that lots five (5) and six (6) are in the flood zone with suggestion by Chairman Gray that lots 5 and 6 be designated with an F. Commissioner Brannen moved, seconded by Commissioner Dornblaser that the FINAL PLAT of Rebsamen Medical Subdivision #1 be APPROVED with the stipulation that Lots 5 & 6 be designated Lot 5F and Lot 6F and that letters of approval from the Water and Wastewater Utilities be received. MOTION CARRIED. 4. SKETCH PLAT AND FINAL PLAT PHASE 1 / Penn Addition City Engineer Reel voiced that the plat includes three lots facing Southeastern Avenue presented previously to the Commission and that a request for information regarding the amount of property owned by Mr. Penn and his intent for the use of it was made by the commission. The item of business was presented by Mr. Penn's son, Richard Penn. Mr. Reel related that the existing street serves as an open channel and is a natural drain. The size of the three lots facing Southeastern were discussed and it was determined that the sixty (60) ft. lots would require the property being rezoned form R-0 to R-1. Mr. Richard Penn said there would be no problem with the developer in requesting the rezoning. There was discussion regarding a side. street and whether or not it should be developed at this point: The general consensus was that it would need to be developed at the time the lots west and north of the street are developed. Commissioner Brannen moved, seconded by Commissioner Payne to APPROVE the SKETCH PLAT of PENN ADDITION with the stipulation that lots 1, 2 and 3 be rezoned from R-0 to R-1. MOTION CARRIED. Mr. Richard Penn related that Mr. Akridge has verbally agreed to enter into the development of the street. The development of half streets was discussed with City Engineer Reel voicing that past experience has not been good. It was the consensus of the Planning Commission that the FINAL PLAT would not be dealt with until after the rezoning of the three lots along Southeastern is finalized. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 12, 1993 7:00 P.M. - 8.40 P.M. Commissioner Brannen moved, seconded by Commissioner Foster to set a public hearing for 7:00 p.m. at the next Regular Planning Commission Meeting regarding the rezoning of Lots 1, 2 & 3 of the Penn Addition from R-0 to R-1. MOTION CARRIED. 6. SKETCH PLAT and PRELIMINARY PLAT PHASE 1 / Penn Point Subdivision City Engineer Reel voiced that Mr. Richard Penn has acquired thirty-eight of thirty-nine acres of property on the northwest quadrant of the intersection of Harris Road and the new extension of West Main Street immediately behind the houses which face Harris Road from the west side. He said that the city has no problem with the sketch plat. Commissioner Brannen raised a question regarding the length of the culdesac (527 feet). He pointed out the code requirement of five hundred (500 feet). There was a lengthy discussion regarding ingress and egress into the subdivision and the possibility of tying streets together in future development of property owned by Metropolitan Trust. Alderman Keaton, representing the developer, voiced that sewer is available to serve the lots indicated on the Sketch Plat and Preliminary Plat. He said that an outlet going north could be a planning possibility in a Final Plat. Commissioner Payne moved, seconded Commissioner Piggee that the Sketch Plat of Penn Pointe be APPROVED as presented with some adjustments on the release point on the road to the west. MOTION CARRIED. Mr. Keaton voiced that the proposed fourteen acre lake will probably be "common property" owned by the property owners along the lake. He said that the lower side of the lots are in the flood zone and that a final plat may possibly be altered with regard to the same. There was discussion regarding flood plain regulations. Commissioner Brannen voiced further concern with regard to the 527 foot culdesac and the possibility of the safety of residents in an emergency situation. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 12, 1993 7:00 P.M. - 8.40 P.M. Mr. Keaton voiced that the lake is a part of the development and that property owners will be assured of the same adding that maintenance, mowing, improvements, etc. will be the responsibility of the property owners. It was noted that access to the lake exists between lots 13 and 14 and 8, 9 and 10. Commissioner Payne moved, seconded by Commissioner Dornblaser that the PRELIMINARY PLAT of PENN POINTE SUBDIVISION be APPROVED with a waiver for the length of the culdesac and the stipulation of further easements. MOTION CARRIED. DEVIATION IN AGENDA: Chairman Gray apologized for not being in attendance at the last Planning Commission Meeting and voiced appreciation to Commissioner Brannen for his good work as Vice Chairman. Chairman Gray noted that Mr. Fred West presented a $50.00 check and legal description to rezone Lots 3, 4, 9 and 10 of the Grace Brown Subdivision (Revised) to City Engineer Reel during the Planning Commission Meeting.
