OPENING REMARKS: ROLL CALL: Commissioners: Rudy Reid, Jim Dornblaser, Art Brannen, Tad Green, Lester Piggee, Paul Payne, and Jack Patton answered ROLL CALL. Chairman Gray also answered ROLL CALL and declared a quorum. Ms. Connie Foster came in at approximately 7:18 p.m. PRESENT NINE (9), ABSENT (0). Others in attendance for the meeting were City Attorney Robert E. Bamburg, City Engineer Duane Reel, Deputy City Clerk Susan Goings, Code Enforcement Officer Mr. Wayne Cox, Computer Tech /Receptionist of the Engineering Department Mylissa Founds, Mr. Tommy Bond of Bond Engineering and Mrs. Bond, petitioners and other interested persons. DEVIATION IN AGENDA: a. REZONING Lots 3, 4, 9 & 10 Grace Brown Addition (Revised) from R-1 to C-2 CHAIRMAN GRAY OPENED THE PUBLIC HEARING AT APPROXIMATELY 7:02 P.M. No person spoke for or against the rezoning. CHAIRMAN GRAY CLOSED THE PUBLIC HEARING AT APPROXIMATELY 7:03 P.M. After a short discussion by the Planning Commission regarding the parcel and the zoning classification of surrounding properties it was determined that documents of property ownership with regard to the rezoning request had not been submitted by the petitioner. The following motion was made: Commissioner Art Brannen moved, seconded by Commissioner Rudy Reid that the rezoning request regarding Lots 3, 4, 9 & 10 of the Grace Brown Addition (Revised) be tabled until ownership documents are on file. MOTION CARRIED. b. REZONING: PENN ADDITION Phase I (So. Eastern Ave.) from R-0 to R-1 CHAIRMAN GRAY OPENED THE PUBLIC HEARING AT APPROXIMATELY 7:11 P.M. No person spoke for or against the rezoning. CHAIRMAN GRAY CLOSED THE PUBLIC HEARING AT APPROXIMATELY 7:12 P.M. It was pointed out that the rezoning request was presented by Mr. Boyce Penn, who was present for the meeting, as requested by the Planning Commission at their meeting of July 12, 1993. Commissioner Brannen moved, seconded by Commissioner Payne to recommend to the City Council that three lots facing Southeastern CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 9, 1993 7:00 P.M. - 7:50P.M. Avenue in Penn Addition, Phase I, be rezoned from R-0 to R-1. MOTION CARRIED. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brannen moved, seconded by Commissioner Patton that the minutes of the July 12, 1993 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUEST TO SET UP PUBLIC HEARINGS: a. STREET CLOSING: Blair Drive (adjacent to So. side of Lots 1, 2, & 3 Blk 8, & Lots 1-9, Blk 7 Bomber Base Addition City Engineer Reel explained that the street was included in the Bomber Base Addition as platted in the 50's and that Blair Drive was a half street with 25' on the plat dedicated as street right-of-way. He related that the property would revert back to adjacent property owners if closed as requested. He said that the city has no objections to the request to close the street. Commissioner Brannen moved, seconded by Commissioner Piggee to set a public hearing at 7:00 p.m. during the Regular Planning Commission Meeting on September 13, 1993 to hear the request to close Blair Drive (adjacent to So. side of Lots 1, 2, & 3 Blk 8, & Lots 1-9, Blk 7 Bomber Base Addition). MOTION CARRIED. b. REZONING: PARCEL LOCATED AT HWY 294 & SPENCER ST. FROM C-3 TO C-1 City Engineer Reel pointed out that the parcel was rezoned several years ago to C-3 and that property owners at this time desire to build a residence on the parcel which the C-3 zoning does not allow. He said that by down-grading the zoning classification, a residence could be built and a small shop or quiet business would also be allowed in the C-1 zone. Mr. Jim Durham represented the petitioners, presenting their request for rezoning and explaining their intent to construct a dwelling on the parcel which is legally described by metes and bounds. Legal Description as follows: Part of the NE1/4 of Section 31, T-3-N, R-10-W, in the City of Jacksonville, Pulaski County, Arkansas, being more particularly described as follows: Beginning at the intersection of the east right-of-way line of Spencer Street and the north right-of-way line of Military Road; thence North along said east right-of-way line of Spencer Street, 2 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 9, 1993 7:00 P.M. - 7:50 P.M. 295.5 feet; thence East, 140.0 feet; thence South, 193.0 feet to the north right-of-way line of Military Road; thence southwesterly along said right-of-way line of Military Road, 173.1 feet to the point of beginning. Mr. Durham explained the intended position of the residence to be constructed on the parcels under discussion. Chairman Gray pointed out that the Planning Commission would probably raise questions at the public hearing regarding the intended use of the three tracts, a, b & c, owned by the petitioner. Commissioner Piggee moved, seconded by Commissioner Dornblaser that a public hearing be set for 7:00 p.m. during the next Regular Planning Commission Meeting for the rezoning of the parcel legally described above on Spencer Street from C-3 to C-1. MOTION CARRIED. Commissioner Foster abstained in that she came in at approximately 7:18 p.m. during discussion on the item of business. c. CLOSING OF AN ALLEY: FIRST METHODIST CHURCH Mr. Tommy Bond explained that proposed construction by the church will include a family life center and a new sanctuary. He related that the alley is owned by the church along with an office building previously owned by Peacock Realty, a residence and a parking lot on the east side of the property. He said that the alley is used to access some parking at the back of the existing buildings. He pointed out that the new sanctuary will seat approximately 566 noting that there will be 160 parking spaces which exceeds code requirements. City Engineer Reel concurred that the alley is owned by the church and Mr. Bond voiced that no utilities exist in the alley. Commissioner Brannen moved, seconded by Commissioner Tad Green that a public hearing be set for 7:00 p.m. during the next Regular Planning Commission Meeting regarding the closing of an alley as requested by the First Methodist Church, 220 Main St. MOTION CARRIED. d. LUCKY HEIGHTS ADDITION: STREETS, ALLEYS, EASEMENT CLOSING City Engineer Reel stated that the subdivision is located West on General Samuels Rd. in the area of the Credit Union whose attorneys feel that the closings are necessary. Commissioner Dornblaser moved, seconded by Commissioner Piggee that a public hearing be set for 7:00 p.m. during the Regular Planning Commission Meeting regarding a request by the Ark. Federal Credit Union regarding all streets, alleys and easements in the Lucky Heights Addition. MOTION CARRIED. REQUEST TO APPROVE BUILDING PERMITS: 804 TRICKEY LANE: GARAGE (Petitioner Joe Lehman) Mr. Joe Lehman represented his request to build a garage on a lot which joins the lot on which his house is built. Chairman Gray questioned Mr. Lehman with regard to having the two lots platted as one. Mr. Lehman voiced that if he did replat the lots, he would not be able to construct a garage larger that 650 sq. ft. which is not the size he desired. He said that at this time no electricity is planned for the garage. It was pointed out by Chairman Gray that the zoning of the lot is R-2. Commissioner Brannen moved, seconded by Commissioner Payne that the building permit request of Mr. Joe Lehman to construct a garage on a parcel addressed as 804 Trickey Lane and legally described by metes and bounds be approved. MOTION CARRIED. b. JACKSONVILLE FUNERAL HOME, 1504 Loop Rd.: MAUSOLEUM Mr. Boyce Moore represented the item of business before the Planning Commission. City Engineer Reel voiced that what is requested complies with the zoning of the property and that it meets all setback and clearance requirements, that he is not asking for anything out of the ordinary. He said the city has no problem initiating a building permit for the structure as requested. Mr. Moore stated that the funeral home is requesting to use the property as it has been zoned, that the cemetary has been in existence since 1958 and that one mausoleum exists on the property at this time. CITY OF JACKSONVILLE, ARKANSAS` REGULAR PLANNING COMMISSION MEETING AUGUST 9, 1993 7:00 P.M. - 7:50 P.M. A question was posed by Commissioner Rudy Reid regarding the setback off Loop Road. Mr. Moore stated that the proposed construction will be sixty (60) feet off Loop Rd. City Engineer Reel said that a twenty-five (25) ft. setback is required by Jacksonville Municipal Code. Mr. Moore stated that the mausoleum as proposed would be about eighteen (18) feet from the property line and that the sidewalk would be about thirteen (13) or fourteen (14) feet from said line. Mr. Moore related that the construction of the mausoleum has already been approved by the Health Department and the Cemetary Board. There was a short discussion regarding the front and side yard setbacks as related to the property line. Commissioner Dornblaser moved, seconded by Commissioner Green that the building permit requested by Jacksonville Funeral Home be approved with the stipulation of a proper twenty-five (25) foot setback off Loop Road. MOTION CARRIED. c. REBSAMEN HEALTH EDUCATION CENTER (between Reb. Hospital and the Convalescent Manor) Chairman Gray presented the item of business. The architect, Mr. Robin Y. Borne represented the item before the Planning Commission. He voiced that a multi-purpose room, rooms for various training programs, office space etc. is proposed in the construction. He did note that some twenty parking spaces would be taken in the construction project adding that the Fire Marshall had given approval with regard to a fire lane. He said there would be work to the north of the building with regard to traffic and that future parking is planned. It was pointed out by City Engineer Reel that fire codes are met in the construction and that no variances are requested. He said that the building will be used mainly for public purposes especially in the evenings. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING AUGUST 9, 1993 7:00 P.M. - 7:50 P.M. Commissioner Dornblaser moved, seconded by Commissioner Rudy Reid to approve the building permit request of Rebsamen Health Education Center to be constructed on Braden Street. MOTION CARRIED. DEVIATION IN AGENDA: LETTER OF RESIGNATION/BOARD OF ADJUSTMENT Chairman Gray expressed regret that Mrs. Connie Foster would not be able to continue as a member of the Board of Adjustment and also voiced appreciation for her work on the Board. No member of the Planning Commission volunteered to fill the position during the meeting.
