OPENING REMARKS: Chairman Kenny Elliott opened the meeting and requested ROLL CALL ROLL CALL: Commissioners: ,James Davis, Jim Dornblaser, Art Brannen, Tad Green, Lester Piggee, Paul Payne and Bart Gray Jr., were present. Chairman Elliott also answered ROLL CALL and declared a quorum. PRESENT eight (8). ABSENT (1). Others in attendance for the meeting were City Attorney Robert Bamburg, City Engineer Diane Reel, Receptionist/Computer Technician of the Engineering Department Mylissa Founds, Deputy Clerk Susan Goings, petitioner Tommy Dupree and an interested citizen. APPROVAL AND/OR CORRECTION OF MINUTES: Regular Planning Commission Meeting of April 13, 1992 Commissioner Brannen moved, seconded by Commissioner Piggee that the minutes of the April 13, 1992 Planning Commission Meeting be APPROVED. MOTION CARRIED. REQUESTS TO SET UP PUBLIC HEARINGS: No requests were submitted. REQUESTS TO APPROVE BUILDING PERMITS: No building permits were submitted. REQUEST TO APPROVE PLATS: PUBLIC HEARING: OPENED AT 7:01 P.M. Chairman Elloitt pointed out that the first item before the Planning Commission is a request by Mr. Tommy Dupree to rezone a parcel located on Cloverdale Rd. adjacent to the New Sewer Treatment Plant, be rezoned from R-1 to R-4. City Engineer Reel stated that the parcel is located on the north and west side of Cloverdale Rd. and backs up to the new treatment facility. He added that a Preliminary Plat containing 24 lots was prepared but was never submitted. Mr. Simpson of 110 Vaughan Street requested a delay in the decision of the Planning Commission due to the fact that his father was out of town and desired more information about the rezoning since he owns property in the area. Chairman Elliott pointed out that there is approximately five acres in the plot. Commissioner Paul Payne withdrew from the voting process due to a conflict of interest. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING May 11, 1992 7:00 P.M. – 7:55 P.M. Mr. Dupree voiced that his request to rezone the property is to accommodate mobile home owners. It was pointed out the parcel should be subdivided; that a plat should be presented to the Planning Commission showing the in-tended use of the property. Mr. Dupree voiced that he would like to subdivide the property one lot at a time. Chairman Elliott closed the public hearing at 7:15 p.m. Commissioner Gray Commented on the request, pointing out that subdividing the approximate five (5) acres should be presented to the Planing Commission in a preliminary plat or development plan. Commissioner Piggee moved, seconded by Commissioner Davis that the request of Mr. Tommy Dupree to rezone an approximate five acre plot from R-1 to R-4 be approved contingent upon submission of a Preliminary Plat being submitted to the Planning Commission and recommended to the City Council. Motion Carried b. Petitioner: Tommy Dupree request/a parcel located in the northwest corner of James St. and Shannondoah to be rezoned from R-3 to C-3. Chairman Elliott opened the public hearing at approximately 7:20 p.m. City Engineer Reel related that he talked with Mr. Dupree previous to the meeting and requested that the zoning classification be changed to C-2 due to the heavy businesses permitted in a C-3 zoned area to which Mr. Dupree agreed. It was pointed out that Eastview Apartment Complex and residential houses adjoin the property and that a drainage ditch goes across the parcel. Chairman Elliott opened the public hearing at approximately 7:25 p.m. Commissioner Bart Gray suggested C-1 commercial zoning since it backs up to ninety-six apartments, twenty-six duplexes and a single-family area. He read from the Jacksonville Municipal Code the businesses permitted in C-1 zoning. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING May 11,1992 7:00 P.M. - 7:55 P.M. Commissioner Davis moved seconded by Commissioner Brannen to recommend to the City Council the rezoning of an approximate two and onehalf acre parcel 1ocated at the northwest corner of James St. and Shannondoah from R3 to C2 as requested by Petitioner Tommy Dupree and legally described in the these minutes. MOTION CARRIED. Commissioner Gray voted NAY. The Legal description of both properties requested to be rezoned are listed below. PETITIONER: TOMMY DUPREE Dupree property on Cloverdale Road adjacent to new sewer treatment plant on Cloverdale Road. A tract of land located in Sec. 36, T3N, R11W, in the City of Jacksonville, Pulaski County, Arkansas, being more particularly described as follows: Commencing at the Southeast corner of Sec. 36, T-3-N, R11W; thence N 00 20’ 45” W, 1775.98 feet to the point of beginning; thence S 44 22' 47" W 54.3 feet to the northerly rightofway line of Cloverdale Road,; thence N 53 31’05" W along said right- ofway line of Cloverdale Road, 641.46 feet to the beginning of a curve to the left (Delta = 78 43’ 30”, Radius = 401.93'); thence along said rightofway of Cloverdale Road and the curve to the left an arc distance of 552.25 feet; thence continue along said rightofway S 47 45' 25" W, 320.9 feet; thence N 32 16' 18” W, 142.1 feet; thence N 47 45' 25" W, 320.9 feet; thence N 32 16' 18" W, 142.1 feet thence N 47 45' 25" E, 280.75 feet to the beginning of a curve to the right (Delta = 78 43' 30", Radius = 541. 93’); thence along said curve to the right an arc distance of 744.12 feet; thence S 53 31’ 05" E, 587.86 feet to the east 1ine of Sec. 36, T3N, R11W; thence S 00 20’ 45" E along said East line of Sec. 36, 105.63, feet to the point of beginning; containing 5.03 acres, more or less. Rezone from R1 to R4. PETITIONER: TOMMY DUPREE A tract of land lying in the West onehalf (W1/2) of Section 30, Township 3 North, Range 10 West, in the City Jacksonville, Pulaski County, Arkansas, being more particularly described as follow: Beginning at the Northeast corner of Lot 35, Eastview Subdivision, Phase III (as recorded in the Pulaski County Court House in Little Rock, Arkansas, in Plat Book 23, Page 94); thence N 88 degrees 27' E, 288.23 feet; thence S 00 degrees 14' W, 380.0 feet; thence S 89 degrees 16’ W, 315.0 feet; thence N 04 degrees 19' E, 377.3 feet to the point of beginning: Containing 2.62 acres, Rezone from R3 to C3.
