02 JUL 08.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. OPENING REMARKS: Chairman Brannen opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance. ROLL CALL: Commissioners: Susan Dollar, Chad Young, Bobby Lester, Glen Keaton, Tammy Green, and William Montgomery, answered ROLL CALL. Chairman Brannen also answered ROLL CALL. PRESENT seven (7), ABSENT (2). Others present for the meeting were City Engineer Whisker, Mr. Aaron Robinson, Alderman Stroud, Commissioner Mark Stroud, Mr. Tommy Dupree, Mr. Duane Reel, Mr. Harold Crook, members of the press, interested citizens, and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Young moved, seconded by Commissioner Lester that the minutes of the 10 June 2002 Regular Planning Commission meeting be APPROVED. MOTION CARRIED. PUBLIC HEARING(S): BUILDING PERMIT(S): Oak Ridge Ranch Subdivision Lot 5 Representative from Bond Engineering, Mr. Aaron Robinson related that the builder Mr. Dave Kinman understands that there is no water or sewer service available to the subdivision as yet. City Engineer Whisker explained that the streets, drainage, and utilities are mostly complete with minor adjustments to be completed this week. He explained that there are two different electric companies and the electrical lines have not been put in to service the pump station. Discussion ensued regarding the location of fireplugs relative to lot 5, and City Engineer Whisker related that fireplug locations have been designated by the City Fire Marshall. City Attorney Bamburg clarified that the time factor involved with providing service of electrical power for the sewer station would be the defining issue. Developer Jerry Smith addressed the Planning Commission saying that he expected the electric company to have the lines run to the sewer pump station in the next few weeks. He stated that all utilities should be on line in 30 to 60 days. Commissioner Keaton moved, seconded by Commissioner Green to approve the building permit for lot 5 of the Oak Ridge Ranch Subdivision pending completion of all utilities. Discussion ensued if Mr. Kinman would need to wait until the sewer pump station has been serviced for electricity and is operational. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. Commissioner Keaton amended his motion, seconded by Commissioner Green to approve the building permit for lot 5 of the Oak Ridge Ranch Subdivision stipulating that a certificate of occupancy would not be issued until all utilities have been approved. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): PRELIMINARY PLAT of H & H Mobile Home Development. Mr. Harold Crook related that the property is located at the northeast corner of Stanphil and LeMac Drive. City Engineer Whisker related that he has some questions regarding sidewalks for the development. Discussion ensued regarding ownership of the gas line and it was noted that the property is west of the stubbed road and that the property to the east belongs to Mr. Boyce Penn. Commissioner Young questioned if the standard subdivision rules would apply for this type of development. City Engineer Whisker responded that the streets already exist and that sidewalks would be required per City Code, adding that the only exception would be for a culdesac area of less than twenty lots. He related that utilities are provided from Stanphil Road. He then requested utility drawings and noted the gas line, questioning if the gas line was on an easement belonging to Mr. Crook or in a right-of-way and asking who would maintain the property. Mr. Crook stated that he was fairly sure that the gas line was in an easement. Discussion ensued as to the responsible party regarding mowing of the easement, and Mr. Crook related that the gas company has been mowing the easement area since the gas line was established. It was noted that proposed access to the property would be from Stanphil and LeMac Drive. City Engineer Whisker requested that utility drawings be submitted before construction begins. Chairman Brannen questioned the need to table the item of business pending submittal of utility drawings to the City Engineer. Commissioner Green moved, seconded by Commissioner Dollar to table the item of business pending submittal of utility drawings for the next regularly scheduled Planning Commission meeting in August. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. b. FINAL PLAT Oak Ridge Ranch Subdivision City Engineer Whisker related that as mentioned earlier in discussion regarding the request for a building permit for lot 5, the subdivision is nearly complete with the exception of electrical service to the sewer pump station. He stated that it could be approximately one month before service is supplied by the electric company to the pump station. He then added that there are some minor issues regarding the sewer and water, which would be addressed before being forwarded to the City Council for Final Plat approval. He related that the sidewalk begins 400 feet down Maddox Road and runs north into the subdivision, adding that there are sidewalks inside the development on Oak Ridge Road, and Cypress Court. He pointed out that there is a small amount of clean up work and grates for the inlets that are needed to complete the subdivision. Chairman Brannen requested that Final Plats have all issues addressed and completed prior to be submitted to the Planning Commission as a Final Plat. He stated that there should be no exceptions submitted at the Final Plat stage. Commissioner Young moved, seconded by Commissioner Lester to approve the Final Plat of Oak Ridge Ranch Subdivision subject to the developer having utilities approved before being presented to the City Council for Final Plat approval. MOTION CARRIED. c. DEVELOPMENT PLAN for Northlake Subdivision – Lake Lorene City Engineer Whisker related that the developer is proposing to change the floodway. He stated that an engineering study was conducted and submitted to his office proposing to move the floodway southerly, condensing it from the existing Fears Lake to the levy area and creating Lake Lorene. Chairman Brannen questioned if this would cause any concerns regarding the construction of the north belt freeway. City Engineer Whisker related that this would not interfere with the existing north belt freeway as it is completed. He pointed out that the new alignment from US 67 to I-430 has not been chosen as yet. He then questioned if the entire development would be located inside the City limits of Jacksonville and wanted to know if water and sewer utilities would be supplied by the City. Mr. Dupree related that water and sewer would be supplied by the City and that if it were necessary he would annex any property into the City. In response to a question posed by City Engineer Whisker, Mr. Dupree related that the southwest corner of the subdivision would be utilized as a turn around area. He then related that the property consists of CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. approximately 50 to 59 acres. It was noted that part of the property is located within the County, but as part of the floodway it cannot be developed. Discussion ensued regarding the question to annex, and it was the general consensus that any portion of the development located in the County that would be serviced by Jacksonville utilities should be annexed into the City of Jacksonville. City Engineer Whisker related that the area not located within the City limits is the flood plain area, and cannot be developed. He stated that the lake and the development area are both within the City limits. Discussion ensued and Mr. Dupree related that the proposed square footage for the homes in the development would be approximately 2,000 square feet or above. Commissioner Young moved, seconded by Commissioner Keaton to approve the Development Plan for Northlake Subdivision – Lake Lorene area as presented. MOTION CARRIED. d. SKETCH PLAT for Foxwood Gardens Mr. Robinson related that Foxwood Gardens is the proposed development for the remainder of property north of Loop Road in the Foxwood area. He stated that the property is located between Phase IX and Phase X, adding that it is being proposed as a gated community development for garden homes. He related that the property is currently zoned R-0 and that the houses are proposed to be between 1,400 to 2,000 square feet. He explained that the developer would create a borrow pit for dirt thus forming ponds. Chairman Brannen questioned if the lots would need to carry the “F” floodplain designation. It was noted that the Sketch Plat is not required to carry the floodplain designation and that the Preliminary Plat would provide that information. Mr. Robinson then related that the lots would be built up with dirt from the borrow pit to raised pads above the floodplain to provide for home construction. City Engineer Whisker noted that the home construction pads would need to be raised 1 foot above the existing floodplain. Discussion ensued regarding access to the property and Mr. Robinson related that the proposed access would be from Foxwood Drive. Chairman Brannen questioned if the development would accommodate Fire Department equipment and if the only access from Foxwood Drive would be adequate for the Fire Department. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. Discussion ensued regarding the development being proposed with only one access from Foxwood Drive. It was the general consensus of the Commission that the developer should consider a second access from Steeple Chase Drive by lot 84 in order to provide the development with two points of access. Mr. Robinson stated that two accesses could be a consideration and then answered that the borrow areas created as ponds would have water. City Engineer Whisker related that the development is proposed as a planned retirement area. He related that the development would have smaller lots with larger homes than what is normally seen on smaller lots. He stated that there is no current zoning for this type of development, questioning a lack of direction regarding subdivision rules for larger detached homes on small lots. Discussed ensued regarding the R-1A zoning and the maximum house size for an R-1A development. It was noted that the setback dimensions for an R-1A development is a 25-foot front yard, 25-foot rear yard with maximum lot coverage of 30%. City Attorney Bamburg explained that depending on the development R-1A might fit the scope of the development, adding that issues regarding utilities would be addressed during the preliminary plat presentation. He stated that any considerations for rezoning the property should be addressed prior to the submittal of the preliminary plat. Discussion ensued and it was the consensus of the Commission that issues regarding the proper rezoning of the property, a redesign of the western end of the development to provide a second access from Steeple Chase Drive and that the plat show floodplain lot designation until property is brought out of the floodplain be addressed with the preliminary plat presentation. Commissioner Young moved, seconded by Commissioner Keaton to approve the Sketch Plat of Foxwood Gardens with stipulations regarding the rezoning, access from Steeple Chase, and proper floodplain designation. MOTION CARRIED. e. PRELIMINARY & FINAL PLAT/Arthur’s Subdivision Mr. Robinson stated that Arthur’s Beauty College is proposing to build a new daycare center behind Arthur’s Beauty College. Chairman Brannen mentioned concerns regarding sewer and drainage, saying that a development proposed in the area had been denied because of sewer capabilities. City Engineer Whisker related that the drainage flows through a ditch between Quick Silver Plaza and Chambers Trucking. He was unsure as to which manhole the sewer flows into. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. Mr. Robinson related that currently the sanitary sewer connects into a private line, but added that the development is proposed to have a grinder pump station that will send the sanitary sewer into a public manhole. Discussion ensued regarding traffic flow and parking of the development. City Engineer Whisker stated that he would recommend that a second access be made available off North First Street; he then noted that the plat presented did not include setbacks. He suggested that the plat be considered as a preliminary plat only and not as a preliminary/final. Consensus of the Planning Commission was to regard the plat submittal as a preliminary plat. City Engineer Whisker then related that he is unsure if the sewer line runs south along North First Street, or north toward the failed proposed subdivision previously mentioned. Commissioner dollar questioned if the plat should be resubmitted with the revised suggestions. City Attorney Bamburg clarified that the plat could be approved as a sketch plat with conditions for preliminary plat submittal, or disapproved with provided recommendations, or tabled for revision with recommendations. Commissioner Green questioned fencing of the playground area as a safety measure for the children because of its proximity to the freeway, and landscaping for the playground area. Discussion ensued regarding the developer cutting down on the number of proposed parking spaces and providing green areas in the parking lot. In response to a question proposed by Commissioner Green, City Attorney Bamburg related that the owner of the daycare would have to satisfy State daycare codes before being licensed to operate, adding that some type of fencing would be required for the area where the children would play outside. Discussion ensued as to whether recommendations could be stipulated as part of the approval of the subdivision. City Attorney Bamburg clarified that the recommendations regarding green spaces could be strongly recommended but not stipulated until the landscaping ordinance is in place. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING JULY 08, 2002 7:00 P.M. – 7:49 P.M. Commissioner Young stated that he would like to strongly recommend that the dumpster to the west of the development be screened. Commissioner Green stated that she too would like to strongly recommend that a wooden privacy fence be used to fence the playground area with consideration for green space. Commissioner Green moved, seconded by Commissioner Dollar to table the plat for Arthur’s Subdivision regarding consideration for a second access from North First Street, sewer approval from Wastewater Utility, consideration for green space, wooden privacy fencing for the playground area, plat presentation showing building setbacks and screens for dumpsters.
