00 FEB 14.doc CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. - 7:35 P.M. OPENING REMARKS: Chairman Brannen opened the meeting at approximately 7:00 p.m. expressing appreciation for those in attendance and requested roll call. Chairman Brannen introduced Mr. Gary Buzbee who is hired as City Engineer with the retirement of present City Engineer Duane Reel. ROLL CALL: Commissioners: Ken Nabors, Bill Corroum, Bart Gray, Lester Piggee, Dean Wilborn, and John Hardwick answered ROLL CALL. Chairman Brannen also answered ROLL CALL and declared a quorum. Commissioner Piggee arrived at approximately 7:06 p.m. PRESENT six (6), ABSENT (2). Others present for the meeting were City Engineer Reel, Alderman Freddie Gentry, Mr. Tommy Bond, Patriot Reporter Peggy Koury, and petitioners. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Corroum moved, seconded by Commissioner Nabors that the minutes of the 10 January 2000 Regular Planning Commission Meeting be APPROVED. MOTION CARRIED. PUBLIC HEARING(S) REZONING: 1200 Lemac Drive from R-3 to R4 At approximately 7:01 p.m., Chairman Brannen opened the public hearing. Mr. Harold Crook related that his intention is to sub-divide the property for mobile home lots as an unsuccessful attempt to sell the property. At approximately 7:03 p.m., Chairman Brannen closed the public hearing. Commissioner Wilborn moved, seconded by Commissioner Nabors to approve the rezoning of 1200 Lemac Drive from R-3 to R-4. MOTION CARRIED with Commissioners Nabors, Corroum, Piggee, and Wilborn voting AYE. Commissioner Gray abstained and Commissioner Hardwick voted NAY. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. - 7:35 P.M. REZONING: 1216 Military Road from R-1 to C-3 At approximately 7:05 p.m., Chairman Brannen opened the public hearing. Mr. Sammy Crook related the desire to place a car lot for the requested location. At approximately 7:06 p.m., Chairman Brannen closed the public hearing. Commissioner Gray related that the rezoning request is in conflict with the Land Use Map which shows the property as residential. It was noted that the Land Use Map would need to be amended to consider the rezoning request. Discussion ensued regarding the procedure to rezone from residential to commercial. Commissioner Piggee moved to recommend a change in the Land Use Map regarding the rezoning request. MOTION DIED FOR LACK OF A SECOND. Mr. Sammy Crook questioned the possibility of a variance instead of a rezoning. Further discussion ensued and it was determined that a variance could not be granted against the Land Use Map and that the use of a car lot was not an allowable conditional use for R-1. Commissioner Hardwick moved, seconded by Commissioner Corroum to deny the request to rezone based upon the Land Use Map and the current zoning of R-1. MOTION CARRIED. In response to a question from Commissioner Piggee, City Attorney Bamburg related that the process to change the Land Use Map is multi-faceted task. He stated that the Commission would begin by looking at the nature of the land and then determine if modification is appropriate. He further related that a recommendation from the Planning Commission would be brought before the Council for vote to change the Land Use Map. He stated that if the Land Use Map were amended, then the petitioner would need to submit a rezoning request in compliance with that change. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. - 7:35 P.M. Commissioner Hardwick requested that the petitioner of Lemac Drive be informed of requirements prior to the sale of lots for mobile homes. REQUEST TO APPROVE PLATS: a. PRELIMINARY PLAT Northlake Subdivision Phase IX Chairman Brannen read notes from City Engineer Reel, saying that Northlake Subdivision Phase IX is a continuation of the subdivision and sketch plat and that utility plans have been approved. Mr. Bond related information regarding the location of the lots in Phase IX in relationship to Bucky Beaver, which was approved last spring. He then related that lots 333, 343, and 392 that are currently in the flood plain but would be brought out. Discussion ensued and Mr. Bond related that there are plans to build a lake in that area of the subdivision. Commissioner Piggee moved, seconded by Commissioner Wilborn to approve the Preliminary Plat of Northlake Phase IX with the “F” flood plain designation for lot 333, 343, and 392. MOTION CARRIED. PRELIMINARY PLAT Deer Creek Subdivision Phase II Chairman Brannen related that the subdivision is located in Gravel Ridge, Pulaski County and the sewer is served by an improvement district for the Gravel Ridge area, water is served by North Pulaski County with street and drainage specification overseen by Pulaski County and will be maintained by Pulaski County. Discussion ensued that the preview of the Planning Commission is approval regarding the geometric design of the subdivision. Commission Wilborn moved, seconded by Commissioner Piggee to approve the Preliminary Plat of Deer Creek subdivision. MOTION CARRIED. REQUEST TO APPROVE BUILDING PERMITS: REQUEST/STREET OR ALLEY CLOSING: CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING FEBRUARY 14, 2000 7:00 P.M. - 7:35 P.M. GENERAL: Jacksonville Planning Commission Annual Report Commissioner Corroum moved, seconded by Commissioner Nabors to approve the 1999 Jacksonville Planning Commission Annual Report. MOTION CARRIED. ANNOUNCEMENTS: GREEN ORDINANCE Discussion ensued regarding progress regarding the “Green Ordinance” and it was noted that members included John Hardwick, Tommy Bond, Alderman Gentry, Alderman Fletcher, Bonita Round, and Duane Reel. Mr. Bond volunteered to serve as Chairman to the Committee in response to a request from Planning Commission Chairman Brannen and schedule a meeting promptly. AHOD DISTRICT Commissioner Hardwick discussed manufactured housing and reviewed the zoning so as to clarify definitions. He related that R-4 allows both subdivisions and parks, adding that he would like to address the requirements regarding compliance with the overlay district. Discussion ensued and it was determined that a special Planning Commission meeting would be held Monday February 28th at 7:00 p.m. ADJOURNMENT: Chairman Brannen without objection adjourned the meeting at approximately 8.45 p.m. Respectfully, Susan L.
