AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODE
9 2.90.010; DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.

WHEREAS, the Jacksonville Advertising & Promotion Commission,
created by Ordinance No. 1193, determines appropriate expenditures for the
development, establishment, improvement, maintenance, and operation of
recreational and tourist facilities within the City of Jacksonville; and,
WHEREAS, it has been determined that certain modifications are needed to
the terms and conditions to obtain more qualified candidates for the Commission,
and it is in the best interest of the citizens of the City of Jacksonville that said Code
be amended to allow a broader membership range.
NOW, THEREFORE, BE rr ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THA T:

SECTION ONE: Pursuant to ACA ~ 26-75-605, JMC ~ 2.90.010 shall be
amended, modified, and revoked as follows:

The Advertising and Promotion Commission shall consist of seven (7)
members. All shall be appointed by the Jacksonville City Council, and membership
shall consist of the following: two (2) members of the Jacksonville City Council;
four (4) members who are Pulaski County residents and owners and/or managers
of businesses/entities in the travel industry, three (3) of whom own and/or manage
a restaurant, hotel, motel, Bed and Breakfast, or other temporary lodging facilities
located within the city limits of Jacksonville, Arkansas; and, one (1) Jacksonville
resident who shall be from the public at-large. The four (4) business
representatives shall serve four (4) year staggered terms, the at-large member shall
serve a term of four (4) years, and the City Council member(s) shall serve the terms
of their offices. All appointments to and service of this Commission shall be
conducted under the terms and conditions outlined in ACA ~ 26-75-605 and other
applicable local, state, and federal law.
SECTION TWO: All Ordinances or parts thereof in conflict herewith are
hereby repealed to the extent of such conflict.

SECTION THREE: It is hereby ascertained and declared that it is imperative
to provide for the continued efficient operation of the Advertising & Promotion
Commission is essential to our community. Therefore, an emergency is hereby
declared, and this Ordinance, being necessary for the immediate preservation of the
public peace, health and safety, shall take effect and be in force from and after its
passage.
