AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE
OF PURCHASING CURBSIDE RECYCLING CONI'AINERS FOR USE IN THE
CITY OF JACKSONVILLE'S RECYCLING PROGRAM; AND, FOR OTHER
PURPOSES.

WHEREAS, in an effort to expand the City of Jacksonville's recycling
program, the City must purchase curbside recycling containers for use by
the citizens of Jacksonville; and,
WHEREAS, the unusual nature and format required of containers
currently being used by Jacksonville citizens, and the limited number of
sources available for such. After some research, only one vendor can
provide the specific containers at a reasonable cost.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of
purchasing curbside recycling containers for use In the expansion of the
City of Jacksonville's recycling program would be costly and non-
productive, making said competItive blading unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived,
pursuant to ACA ~14-58-383, to purchase additional curbside recycling
containers for use in the City of Jacksonville's recycling program.
Authorization is hereby given to the Mayor and City Clerk to enter Into a
purchase contract with SCI A-I Plastics, Ltd., of Ontario, Canada, to
purchase up to Three Thousand (3,000) curbside containers at a maximum
cost of Seventeen Thousand Three Hundred Seventy Dollars ($17,370.00),
at a rate of Five and Seventy-nine Dollars ($5.79) per unit cost, together
with applicable tax and other appropriate charges.
SECTION THREE: All Ordinances, parts of Ordinances, or
previous actions taken by said Council in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION FOUR: This Ordinance shall take effect immediately
upon passage and publication, as provided by and subject to the
requirements of applicable law.
