ORDINANCE NO. :1.258 (# 20 - 05)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILL~ ARKANS~~_FOR THE PURPOSE OF OBTAINING NEW
PARTITIONS FOR THE JACNI'ONVILLE COMMUNITY CENTER'S BANQUET
HALL; AND, FOR OTHER PURPOSES.

WHEREAS, the partitions used by the Parks & Recreation Department are
vital to the continued use and benefit of citizens using the Community Center's
Banquet Hall. In order to provide improved and more efficient service to users of
the Community Center, an upgrade is necessary; and,
WHEREAS, innerplan of Little Rock, Arkansas, which sells and installs
partitions of the nature needed, is the only responding source for said project. Past
experience has shown that the company prOVides quality equipment at reasonable
rates so the Department believes the rate bid IS competitive and innerplan's
instaflation time is satisfactory. As such, it is recommended that the City contract
with innerplan of Little Rock, Arkansas, for the purchase and installation of said
partitions, and innerplan has agreed to provide such needed partitions with
appropriate installation and warranty at a fair and reasonable rate.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of obtaining new
partitions for the Banquet Hall of the JacksonvTIle Community Center for the Parks
& Recreation Department would be costly, non-productive, and time consuming,
making said competitive bidding unfeasible and Impractical.
SECTION TWO: Pursuant to ACA ~14-58-383, competitive bidding is
hereby waived for the purpose of obtaining new partitions for the Banquet Hall of
the Jacksonville Community Center from innerplan of Little Rock, Arkansas.
Authorization is hereby given to the Mayor and/or his designated representative to
execute necessary documents with innerplan of Little Rock, Arkansas for the
purchase and installation of partitions for an amount not to exceed Ten Thousand
Five Hundred Seventy-four and 32/100 Dollars ($ 101574.32). This amount is to be
paid from budgeted 2005 Parks & Recreation Depanment E'quipment funds.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applicable law.
