ORDINANCE NO. 1286 (#19 - 06)

AN ORDINANCE AUTHORIZING THE EXEMPTION OF THE CITY OF
JACKSONVILLE, ARKANSAS, FROM THE SHIELDED OUTDOOR
LIGHTING ACT; AND, FOR OTHER PURPOSES.
WHEREAS, the Arkansas Legislature passed a Shielded Outdoor Lighting
Act during its regular 2005 session requiring replacement of outdoor lighting
fixtures to be shielded. However, in the recent 2006 Arkansas Legislative Special
Session, lawmakers amended the statute to allow municipalities and counties to
adopt ordinances exempting themselves from the law if it is determined to be
cost-prohibitive to install shielded outdoor lighting fixtures; and,
WHEREAS, the Jacksonville City Council has determined that installation of
shielded outdoor lighting fixtures would be cost-prohibitive for the City of
Jacksonville.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:

SECTION ONE: The City of Jacksonville, Arkansas, shall hereinafter be
exempted from the Shielded Outdoor Lighting Act, as authorized under HB 1027,
due to the cost-prohibitive nature of shielded outdoor lighting fixtures.
SECTION TWO: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION THREE: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applicable law.
