ORDINANCE NO. 1285 (#18 - 06)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF COMPLETING REPAIRS
AND REHABILITATION TO THE COMMUNITY CENTER POOL; DECLARING
AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, it is necessary to reRair rehabilitate, and imQrove the entire
surface of the indoor pool area of the Jacksonville Community Center by water
blasting the entire surface to remove all loose plaster and embedded dirt, acid
washing the entire surface to remove any calcium or other calcium based chemical,
etching any remaining smooth surfaces, treating the entire surface to remove oils
and neutralize acid, and apply a primer and one coat of Zeron pool coating to the
pool area; and,
WHEREAS, Walden Chemical, Inc., North Little Rock, Arkansas, has
submitted a reasonable proposal for completion of said repairs at a reasonable rate
and within a short period of time so as to minimize continued interruption and
unavailability of the use of the Community Center pool.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of repairing,
rehabilitating, and improving the indoor pool of the Jacksonville Community Center
would be costly, non-productive, and time consuming, making said competitive
bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA ~14-58-383, competitive bidding is
hereby waived for the purpose of repairing, reliabilitating, and improving the indoor
pool of the Jacksonville Community Center. Authorizafion is hereby given to the
Mayor and/or his designated representative to execute necessary documents with
Walden Chemical, Inc. of North Little Rock, Arkansas, for repair, rehabilitation, and
improvement to the indoor pool area of the Jacksonville Community Center. It is
anticiRated that the repairs, refinishing, and rehabilitation process will be provided
for a total cost not to exceed Twenty-one Thousand Six Hundred FiftY Dollars
($21,650.00) plus applicable taxes due.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: To provide more effectivel~for the comfort and safety
of our citizens and in the operation of our Communi Center, an emergency is
hereby declared to exist. This Ordinance shall take effe immediately upon passage
and publication, as provided by and subject to the requirements of applicable law.
