ORDINANCE NO. 1280 (#13 - 06)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF REPAIRS AND
REHABILITATION TO THE COMMUNITY CENTER POOL CEILING AREA;
DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, it is necessary to rep'air, rehabilitate, and improve the ceiling of
the indoor pool area of the Jacksonville Community Center so as to to prevent
additional damage to the building and allow more efficient use of the utilities
required for said facility; and,
WHEREAS, Howell Utility and Excavation, Inc. has submitted a reasonable
proposal for completion of said repairs and can complete such in a shorter
timeframe than most.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of repairing,
rehabilitating, and improving the ceiling of the Indoor pool area of the JackSonville
Community Center would be costly, non-productive, and time consuming, making
said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA ~14-58-383, competitive bidding is
hereby waived for the purpose of repairin9f reliabilitating, and improving the cening
area of the indoor pool of the Jacksonvi Ie Community Center. Autliorization is
hereby given to the Mayor and/or his designated representative to execute
necessary documents with Howell Utility and Excavation, Inc. of Little Rock,
Arkansas( for repair, rehabilitation.,!, and improvement to the indoor pool area of the
Jacksonville Community Center. it is anticipated that the repairs and rehabilitation
process will be provided for a total cost not to exceed One Hundred Thirty Thousand
Nine Hundred Dollars ($130,900.00).
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION FOUR: To provide more effectivel~for the comfort and safety
of our citizens and in the operation of our Communi Center, an emergency is
hereby declared to exist. This Ordinance shall take effe immediately upon passage
and publication, as provided by and subject to the requirements of applicable law.
