ORDINANCE NO. 1274 (#7 · 06)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF JACKSONVILLE,
ARKANSAS, FOR THE PURPOSE OF REPAIRING AND REPLACING THE CEILING IN THE POOL
AREA OF THE JACKSONVILLE COMMUNITY CENTER; DECLARING AN EMERGENCY; AND,
FOR OTHER PURPOSES.

WHEREAS, it is necessary to remove damaged insulation, repair, and improve the ceiling of
the indoor pool area of the Jacksonville Community Center so as to to prevent additional damage to
the building; and,
WHEREAS, Howell Construction has submitted a reasonable proposal which includes a two
stage approach. The first stage would be to remove all ceiling insulation to visually observe the entire
indoor ceiling area and determine the extent of the damage, if any. The second stage would be to
then install and provide all required improvements needed to protect the exterior roof.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCil OF THE CITY OF
JACKSONVillE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of removing ceiling insulation
from the ceiling of the indoor pool area of the Jacksonville Community Center would be costly, non-
productive, ana time consuming, making said competitive bidding unfeasible and impractical.
SECTION TWO: Pursuant to ACA 914-58-383, competitive bidding is hereby waived
for the purpose of contracting to remove all ceiling insulation and assessing any damage to the indoor
pool ceiling of the Jacksonville Community Center. Authorization is hereby given to the Mayor and/or
his designated representative to execute necessary documents with Howell Construction for a
contractual agreement to remove the existing ceiling insulation in the indoor pool area of the
Jacksonville Community Center and assess tne damage, if any, so as to determine any needed
repairs. It is anticipated that the removal and assessment process will be provided for a total cost not
to exceed Eighteen Thousand Dollars ($18,000.00).
SECTION THREE: . All Ordinances, parts of Ordinances, or previous actions taken by
said Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: To provide more effectively for the comfort and safety of our citizens,
an emergency is hereby declared to exist. This Ordinance shall take effect immediately upon passage
and pubflcation, as provided by and subject to the requirements of applicable law.
