ORDINANCE NO. 948 (#11-91)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
AUTHORIZING REPAIRS TO A DUMP TRUCK OWNED BY THE JACKSONVILLE
WASTEWATER UTILITY; DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES.
WHEREAS, it is necessary for the Jacksonville Wastewater
Utility to quickly repair the damage to a 1987 GMC dump truck
for continuation of daily operations in the UtilityPs con-
struction projects; and,
WHEREAS, Van Pelt Auto and Body Shop of Jacksonville,
Arkansas, has agreed to provide a short repair period, proper
repair and/or replacement of all necessary and damaged parts,
and a discounted price for such repairs/replacements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purpose of
repairing a Jacksonville Wastewater Utility 1987 GMC dump
truck would be costly and non-productive, making said
competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pur-
suant to Arkansas Code of 1987 Annotated Section 14-58-'~,
for the purpose of authorizing repairs to a Jacksonville
Wastewater Utility 1987 GMC dump truck. Authorization is
hereby given to the Wastewater Utility's Manager to enter
into a contract with Van Pelt Auto and Body Shop of
Jacksonville, Arkansas, to provide said repairs at a price of
Six Thousand, Three Hundred Fifty and 00/100 Dollars
($6,350~OO).
SECTION THREE: All Ordinances and Resolutions, or parts
thereof, in conflict with this Ordinance are hereby repealed
to the extent of that conflict~
SECTION FOUR: Immediate implementation of the terms of
this Ordinance are necessary to the sound operation welfare
of the citizens of Jacksonville~ Therefore, an emergency is
hereby declared and this Ordinance shall take effect
immediately upon its passage and publication, as provided by
and subject to applicable law.
