ORDINANCE NO. 573 AN ORDINANCE REGULATING WRECKER COMPANIES WHICH RECEIVE CALLS FROM THE JACKSONVILLE POLICE DEPARTMENT, ADDING CHAPTER 5.32 OF THE JACKSONVILLE MUNICIPAL CODE~ AND FOR OTHER PURPOSES NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: S~CTION 1. There is hereby added to the Municipal Code of Jacksonville, Chapter 5.32 which is to read as follows: Sections: 5.32.010 5.32.020 5.32.030 5.32.040 5.32.050 5.32.060 5.32.070 5.32.080 5.32.090 5.32.100 5.32.110 5.32.120 5.32.130 5.32.140 5.32.010 CHAPTER 5.32 WRECKER COMPANY REGULATIONS Requirements. Service. Insurance, Storage area. Maintenance. Equipment. Tools. Request for Wrecker, False Notification. Wrecker Availability. Traffic Regulations. Arrival Procedure. Debris Removal. Towing Records. Unclaimed Vehicles. Service Charges. Requirements. Each wrecker cOlll~any who wishes to receive requests for services from the Jacksonville Police Department, except calls that arise from the requests of owners of vehicles, must imme- diately confoLlli to the following regulations and specifications, as well as having paid its Jacksonville Privilege Tax. Failure to so conform to these regulations and specifications will con- stitute grounds for the summary removal of a wrecker company from the Jacksonville Police Department call list of approved wrecker companies. 5.32.020 Service. Each company must provide twenty-four (24) hour contin- uous service for the acceptance of vehicles and for requests for service. 5.32.030 Insurance, Storage area. Each company must have inG"o,ont.d!nuous effect , liability insurance in sufficient amount to cover any claim against them resulting from property damage or injury to persons occurring while they are rendering service upon request of the Jacksonville Police Department. FurtheLluore, each company must maintain a lighted storage area surrounded by fencing adequate to prevent entrance by unauthorized persons and must hold itself responsible for any theft or vandalism to vehicles or other property within q,Lf its care or control. Furthe1.111ore, each company must have available for continuous storage use, an area which is secure from entry by all unauthorized persons in which vehicles stored for the pUL~ose of preserving evidence may be held. 5.32.040 Maintenance. All wreckers must be in good mechanical condition, must bear a current vehi~le-inspection certificate, and must bear a proper commercial license. 5.32.050 Equipment. All wreckers must be equ~pped with a fire extinguisher, ABC type, of not less than 10 lbs. in size, and sufficient amber lights, visible from both front and rear to warn approaching traffic. 5.32.060 Tools. Each wrecker shall be equipped with suffic~ent tools and accessories to efficiently perfo1.~ its service. 5.32.070 Request for Wrecker, False Notification. No wrecker (shall proceed to an accident scene ilinless requested to do so by the Jacksonville Police Department or the owner or driver of the wrecked vehicle. Should a wrecker cOlll!Jany or any of its employees receive notification of an accident from a source other than a police agency, it should iUllllediately notify the proper police agency. 5.32.080 Wrecker Availability. Each company must, upon request for service, either make available, iUllllediately, a sui table wrecker and operator, or else immediately inform the requesting party that no suit- able wrecker is available, so that service may be obtained from another comp~ny if necessary. 5.32.090 Traffic Regulations. All wrecker operators shall obey all traffic regu~ations unless otherwise direct~d by a police officer or police agency. 5.32.100 Arrival Procedure. Upon arrival at an accident scene, the wrecker operator will stand by and will not proceed to work on or remove any vehicle until directed to do so by a Jacksonville police officer. 5.32.110 Debris Removal. It will be the ~esponsibility of every wrecker operator to remove or provide for the removal of all debtis from the highway before leaving an accident scene. 95 5.32.120 Towing Records. Each company must maintain an adequate record of all vehicles towed at the request of the Jacksonville Police De~~rtment, such record to include the date, time, location, make, model, license and serial numbers. Such records shall be made available to the Jacksonville Police Depar~ment at such times as any member therebID may request. 5.32.130 Unclaimed Vehicles. All companies must comply with Section 4 of Act 380 of 1969, which requires the owner of any garage or any type of storage of parking lot to report to the Jacksonville Police Department the vehicles stored on their lot over thirty (30) days and unclam.med. This does not include vehicles stored"tpby arrangement by the owner and situations in which the legal owner is personally known by the owner or operator of the storage facility - Ark. Stat. 75-167.4. 5.32.140 Service Charges. Service charges made by wrecker companies must be reason- able in view of the service performed, the time of day that ser- vice is performed, and the geographical location. Reasonableness will be dete.L111ined by comparison of se rvice charges of a parti- cular company with those of other wrecker compamies within the same general area who perfOl-ill substantially the same services. SECTION 2. All ordinances before mentioned are hereby repealed to the extent of such oonflict. APPROVED AND ADOPTED THIS 7th DAY OF February , 1980.
