AN ORDINANCE REGULATING DUMPING OF WASTE MATERIAL IN THE
JACKSONVILLE CITY STORM DRAINAGE SYSTEM ADDING CHAPTER 8.48
TO THE MUNICIPAL CODE OF JACKSONVILLE\ AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACK-
SONVILLE, ARKANSAS, THAT:
SECTION 1: There is hereby added to the Municipal Code
of Jacksonville, Arkansas, Chapter 8.48, which is to read as
follows:

8.48.010
Unlawful Draining.
It is unlawful for any owner, owners or occupant of any
real property to either purposely, knowingly, recklessly, or
negligently allow any substance other than nOJ..lua1 rain water or
uncontaminated water from the ci ty water sY'ls/tem to be allowed to
run off their property and be dumped into the Ci ty' s StO.LUl
Drainage System, or open ditches connected thereto. If a property
owner, owners or occupant fails to abate such unlawful run off
and subsequent disposal in the City's Drainage System, the City
may abate same, but the owner, owners or occupant will be subject
to civil suit by the city to recoup such expenses incurred.
8.48.020
Inspectors.
Inspectors employed by the Ci ty or Heal th Department ,shall
be responsible for dete.Lluining when section 8.48.010 is being
violated and are required to notify the dwner, owners or occupant
of such violation. Upon notification, the owner , owners or occu-
pant are to abate the illegal run off i~uediately;
8.48.030
Penalty.
Any owner, owners or occupant violating this chapter shall
be subject to a fine of not less than $50.00 a day nor more than
$100.00 a day after notification by the inspectors as mentioned
in section 8.48.020.
SECTION 2: All ordinances and codes conflicting with this
ordinance are hereby repealed to the extent of such conflict.
