WHEREAS, the Jacksonville Animal Shelter enforces the ban on Bull Terrier breeds
throughout Jacksonville in compliance with IMC § 6.04.045(D)(1). However, the Shelter
has researched and located a Pit Bull Terrier Rescue and Foster Service that works
extensively with the Breed, full and/or mixed, to rehabilitate the animals and insure they
are no longer vicious or a dangerous animal. After seeing success with such, the Animal
Control staff recommends to the City Council that our provisions allow for Bull Terrier Breed
animals banned from Jacksonville to be released and relinquished to a Rescue and Foster
Shelter as approved by the Animal Control Supervisor and the Director of Public Works.
SE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS.
SECTION
RKANSAS.-
SECTION ONE.- JMC § 6.04.045(D)(5)(d) is hereby amended and modified tc
read as follows:
d) Any animal seized under the provisions of this Code not reclaimed and
conditions satisfied within Three (3) business days as prescribed herein shall either be:
a) Euthanized in a humane manner; or, b) Released and relinquished by the Jacksonville
Animal Shelter and/or owner(s) to a Bull Terrier Rescue/Foster Service/Shelter as approved
by the Animal Control Supervisor and the Director of Public Works.
SECTION TWO; All Ordinances or parts thereof in conflict herewith are
hereby repealed to the extent of said conflict.
SECTION THREE.- Due to the need to immediately protect and preserve
those animals that fall within the terms of this Code provision, it is necessary for an
emergency to be declared and this Ordinance to take effect immediately for the benefit of
public safety and security. Therefore, this Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of applicable law.
