ORDINANCE NO. 6 0 6
AN ORDINANCE PROVIDING FOR THE WAIVING OF REQUIREMENTS OF COMPETITIVE
BIDDING IN EXCEPTIONAL SITUATIONS WHERE SUCH PROCEDURE IS DEEMED NOT
FEASIBLE OR PRACTICAL; FOR OTHER PURPOSES AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Jacksonville,
deems it necessary to establish an ordinance providing for the waiving
of requirements of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical, and
WHEREAS, Act 28 of 1959 of the General Assembly of the State of
Arkansas and Ark. Statutue 19-4425 provides that the City Council may,
by ordinance, waive the requirements of competitive bidding, and
WHEREAS, the City Council of the City of Jacksonville deems it
necessary to establish such an ordinance, and
WHEREAS, the Jacksonville Police Department cannot get contractors
to bid on renovation of a trailer used for training purposes, and
WHEREAS, it is necessary that such trailer be renovated in order
to properly train the Jacksonville Police personnel, and
WHEREAS, the City Council of the City of Jacksonville deems it
necessary to authorize the Jacksonville Police Department to waive the
requirements of competitive bidding on the renovation of this trailer.
NOW THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE, ARKANSAS, that:
Section 1. That the Jacksonville Police Department is author-
ized to renovate the trailer themselves.
Section 2. That the City Council of the City of Jacksonville,
deems it necessary to waive the requirements of competitive bidding
due to the fact that such is needed immediately to prevent the training
of the Jacksonville Police Department from deteriorating.
Section 3. This ordinance being necessary for the immediate
preservation of the health, safety and morale of the citizens of the
City of Jacksonville, Arkansas, an emergency is hereby declared to
exist and this ordinance shall take effect immediately upon its pas-
sage and approval.
