AN ORDINANCE ESTABLISHING ADDITIONAL COURT COSTS FOR THE CITY
ON CONVICTION OF DRlJNKENNESS OR DRIVING 1AlI-IILE UNDER THE Il'JFLlJENCE
OF INTOXICANTS; DECLARING AN E~ffiRGENCY; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION 1. Pursuant to Arkansas Statutes Annotated Section
22-706.1, we hereby direct the taxing of the following costs
to be collected b~l the Jacksonville ~1unicipal Court:
Cost on criminal convictions, in addition to such costs
as now are or may hereafter be provided by law:
For any conviction on a charge of public
drunkenness-------------------------------- $1.00
For any conviction on a charge of driving
while under the influce of intoxicants----~ $5.00
SECTION 2: The Jacksonville Municipal Court shall tax
said costs in all such cases arising under violation of city
ordinances or state laws, and costs so collected shall be kept
in a separate account by the Clerk and accounted for, and paid
over to the City Treasurer at the same time and in the same
manner as other court costs in the first class of accounts.
SECTION 3: Costs collected under this ordinance shall be
paid into a fund to be used in the purchase, maintenance and
operation of equipment designed to test the fact and degree of
intoxication of persons arrested on charges of public drunkenness,
or driving under the inflliuence of intoxicants. The surplus, if
any, after accomplishment ef the above purpose, may be used in
defraying any other 1 e.gfttmate administrature e,xpense of the court.
SECTION 4: That all ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of any such
conflict.
SECTION 5: Public drunkenness and driving under the influence
of intoxicants has resulted in a serious traffic hazard which is
dangerous to motor vehicle operators~ An emergency is therefore
declared and this ordinance being necessary for the preservation
of the public peace, health and safety shall be in full force
and effect from and after its passage.
APPROVED AND ADOPTED THIS 21 DAY OF APRIL, 1983.
WITH THE EMERGENCY CLAUSE. ORDINANCE EFFECTIVE IMMEDIATELY.
