RESOLUTION NO. 479 (13-96)
A RESOLUTION URGING DEFEAT OF PENDING ARKANSAS HOUSE BILL
1726; AND, FOR OTHER PURPOSES.
WHEREAS, The Arkansas General Assembly is currently
considering House Bill 1726, the so- called "Private Property
Protection Act ", which purports to protect private property.
However, adequate, fair, and reasonable protection of private
property rights is provided through the existing Arkansas
State Constitution, as well as through the 5th Amendment of
the U. S. Constitution; and,
WHEREAS, because House Bill 1726 provisions will create
a myriad of litigation against local governments, the Bill
constitutes a potentially massive unfunded state mandate on
local governments, and implementation of the Bill will
effectively compromise all current and future local
regulatory efforts to insure orderly growth and development
of Jacksonville, it is not in the public's best interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Passage of pending Arkansas House Bill
1726 is not in the best interest of local government or its
citizens. The City Council of the City of Jacksonville,
Arkansas, is vehemently opposed to the so- called "Private
Property Protection Act ", also known as House Bill 1726, and
urges members of the Arkansas General Assembly to vote
against said bill and block its passage into law. Further,
the Council urges all citizens to contact members of the
General Assembly to urge defeat of this Bill.
SECTION TWO: This Resolution shall be in effect from
and after its date of passage.
SECTION THREE: All Resolutions or parts of Resolutions
in conflict herewith are hereby repealed to the extent of
said conflict.
